Course Aims: The course aims to examine the underlying principles governing the structuring of construction contracts. Methods of settling construction disputes will be introduced. Issues related to professional ethics and standard will be examined. The operation ofconstruction contracts under the PRC Contract Law regime will also be introduced. 1. apply established principles in drafting conditions of construction contracts; --- 2. analyse commonly encountered contractual matters; --- 3. explore the nature of construction disputes and its resolution; --- 4. examine professional liabilities and ethics; --- 5. reflect the backgrounds of the development of PRC contract law and construction law; --- analyse the operation of construction contract within the framework of PRC contract and construction law. --- 3. CILO 3 Processes, merits and demerits of the various forms discussed through lectures, tutorials and educational video/film. CILO 4 Fundamentals and leading cases introduced during lectures and scrutinized by way of specially designed tutorial task. CILO 5 Lectures and input from guest speakers where appropriate. CILO 6 Lectures with supplementary reading strongly encouraged. 4. Assessment Tasks/Activities: Coursework: 50% Examination: 50% (Examination duration = 3 hours) To pass a course, a student must obtain minimum marks of 30% in both coursework and examination components, and an overall mark of at least 40% CILO No. Type of assessment tasks/activities Weighting (if applicable) Remarks CILO 1 With regard to specific topics, questions in the examination shall be the pivotal assessment vehicle to evaluate the achievement of the ILO by the students. --- Examination assessment (50%) shall be directed to evaluate the achievement of CILOs on both the technical content as well as the ability to integrate and relate topics addressed. 10% of coursework assessment is directed for discovery of contractual issues through student-led tutorial presentations. A quiz (20%) will be conducted during the course.

CILO 2 A research based coursework assessment is used for the accomplishment of this CILO.
