3. Section 20 – Fixation and Demarcation of Boundaries(1) Boundaries of all villages in the State and of all survey numbers in a village shall be fixed and demarcated by boundary marks.(2) The boundary marks shall be of such specification and shall be constructed and maintained in such manner as may be prescribed.

4. Section 21 – Obligation regarding maintenance and repair of boundary marksEvery tenure holder shall be responsible to maintain and repair at his cost the boundary marks lawfully erected in his holding or on the boundary thereof.The Gram Panchayat shall be responsible to maintain and repair at its cost the boundary marks lawfully erected in the village of its jurisdiction.

Section 22 – Destruction etc. of Boundary MarksIf any boundary mark lawfully erected in a Lekhpal Circle is destroyed, removed or damaged, the concerned Lekhpal is bound to report the matter to the Naib-Tehsildar.The Naib-Tehsildar shall make an inquiry in respect of such report and shall submit his recommendation to the SDO.

6. Section 23 – Power to require erection, repair or renewal of boundary marksThe SDO may require a Gram Panchayat or the Tenure Holder, to erect or restore proper boundary marks or to repair or replace the same as may be prescribed. When the Gram Panchayat or the tenure holder fails, the SDO may cause such repair and recover the cost from the Gran Panchayat or the Tenure holder.

7. Section 24 – Dispute regarding BoundariesThe SDO on his own motion or an application by any person interested, decide, by summary inquiry , any dispute regarding the boundaries on the basis of existing maps and if not possible on the basis of actual possession.If the SDO is unable to satisfy himself as to which party is in actual possession, or if there is any wrongful possession, he shall –In the first case, ascertain by summary inquiry who is the best person entitled to the property, and shall put such person in possessionIn the second case, put the person in possession who has been dispossessed wrongfully, using such force as it is necessary.All the proceeding shall be concluded within 3 months.Any person aggrieved by the order of the SDO may appeal before the Commissioner within 30 days.

8. Section 25 – Rights of way and other easementsIf there is any dispute regarding the route by which a tenure holder or an agricultural labourer shall have the access to his land or the waste or pasture land or any irrigational facility, the Tehsildar may after such inquiry, decide the matter with due convenience of all the parties concerned

9. Section 26 – Removal of ObstaclesIf the Tehsildar finds any obstacle which impedes the free use of a public road, path or a common land of a village or obstructs the source of water, he may direct the removal of such obstacle.

10. Section 27 – Revisional power of SDOThe SDO may call for the record of any case decided by the Tehsildar under section 25,26 for the purpose of satisfying himself as to the legality of such decisions.

11. Section 28 – order not to debar from establishing any right of easementNo order made under this chapter shall debar any person from establishing such right of easements or customary right as he may claim by a civil suit.
