��USM Bylaws, Policies and Procedures of the Board of Regents��VII – 9.00 VIIPOLICY ON VESTING OF CERTAIN RIGHTS UPON IMPLEMENTATION OF PHASE INONEXEMPT OF THE USM PAY PROGRAM (Approved by the Board of Regents, EFFECTIVE July 1, 1996.Amendments approved by the BOR February 2, 1996; AmendedOctober 9). PURPOSE AND APPLICABILITY This policy outlines and guarantees the continuation of VESTING ( Vesting, for purposes of this policy, is defined to be thecontinued application of certain policies to a nonexemptemployee. This vesting shall cease when the employeeaccepts a promotional transfer or reclassification to theexempt groupAfter that time, the employee shall begoverned by all polici class and new job group. Layoff Employees whose job class or job group category ischanged upon implementation of the USMPay Programshall not lose coverage under policies governing layoffand reinstate Termination mployees whose job class or job group is changed uponthe implementation of the USM Pay Program shall notlose coverage under policies governing termination for Annual Leave Accrual Rates Employees whose job class or job group is changed uponimplementation of the USM Pay Program shall not loseany current annual leave balance because of a change Employees with less than 20 years of service andwhose designation was associatestaff,unclassified staff, acad

emic administrative staffor administrative personnel atthe time ofimplementation and whose positions are ��USM Bylaws, Policies and Procedures of the Board of Regents��VII – 9.00 changed tothe job group ofnonexempt shall continue to earn22 days of annual leave until they reach 20 yearsf service. On the 20th year they shall startearning annual leave at the rate of 25 days peryear. Employeeswith 20 or more years of serviceat the time of implementation shall earn annualleave at the rate of 25 days per year. If there is a change to an employee’s positionthrough promotion or transfer to theexempt groupthe employee shall be governed by annual leavepolicies and procedures pplicable toher/his newjob class and new job Group. Grievance Procedures and Special Action Appeals Employees whose job class or job group is changed uponimplementation of the USMPay Program shall not loseny grievance and appeal rights or access to the grievance and/or the special action appeals processesthat were available to them and in effect for their jobclass or job group prior to the change. IMPLEMENTATION PROCEDURES: Each President shall identify his/her designee(s) as appropriate for this policy, develop procedures as necessary to implement this policy, communicate this policy and applicable procedures to his/her institutionalcommunity, and post it on its institutional website.
