What do we know about advance premium tax credits?

Consumers

It’s my ‘Obamacare’ money.It makes my insurance less expensive.

I never actually get this money, it goes to the insurance company on my behalf.

The amount changes from year to year, but I’m not always sure why.

I have no idea how it is calculated.

Preparers

If you have these tax credits, you have to file taxes.You should have a 1095-A form showing how much you received in tax credits.If you had more than one plan, you will have more than one 1095-A form.I have a general idea about how the amount is calculated.

Navigators

Challenges Affecting Consumers During Tax Season

Their tax credit changed due to income change, and they could not verify for certain if

their 1095-A looked right or not.Consumers did not always bring their 1095-A’s with them.Their

income changed during the year, and they didn’t report it

to HHS, meaning when they get to you, they owe excess or they are owed additional tax credit, depending on their final income level.

Tax preparers did not always look for exemptions for consumers to avoid penalties for lack of coverage, even when many consumers qualified for hardship or other exemptions.Complications with family plans where a

family member changes tax status during the year. Even though everyone who gets an APTC is supposed to file, 710,000 Americans across the US who received APTC’s did not file

!

You are filing a Form 1040, 1040A, or 1040EZ (even if you are filing it because you are a

dual-status alien for your first year of U.S. residency or a nonresident or dual-status alien who elected to file a joint return with a U.S. spouse),

You can't be claimed as a dependent by another taxpayer,

You or anyone else in your tax household didn't have minimum essential coverage for each month of 2015, and

You want to report or claim a coverage exemption for yourself or another member of your tax household. Attach Form 8965 to your tax return (Form 1040, Form 1040A, or Form 1040EZ)

Minimum Essential Coverage

If a consumer has coverage through the Grady Card program or through Mercy Care, does that count as Minimum Essential Coverage? Prescription cards?

NO. These consumers, if above 138% FPL, will be responsible for gaining full coverage OR will have to pay the penalty.

Summary:

Make an effort to identify and contact your local AARP and VITA tax preparation site so you can work together in serving consumers during tax season.Encourage your agency to put a link to the “Reliable and Free Tax Map of Georgia” on their website so it is easy for your clients to access and for you to pull up when making a referral.

Be prepared to help tax preparers locate the consumer’s 1095-A form online and do the math to help the consumer check to see if it is correct.Keep the federal poverty chart and list of exemptions handy for when dealing with ACA-related tax issues.

Be sure to make a referral to a tax site DURING ENROLLMENT.
