03
Mr. Mori’s requests: 12 demerit points against the hunting license of those who commit trespass with the intent to damage private property.
Alternate: Minimum of a 2-year waiting period to apply for game tags placed on those who willfully trespass, which impacts bonus points.
Not listed, but discussed-destruction of property
Hunting guides that commit trespass willfully or incidentally have their guide license revoked.
04
NRS 503.240 Unlawful to hunt, trap or fish upon certain private property without permission.
1. It is unlawful for any person to hunt, fish in nonnavigable waters or trap upon land which is private property where the person has been warned by the owner or occupant of the property not to trespass in the manner prescribed in NRS 207.200, or where signs are displayed forbidding hunting, trapping or fishing without permission obtained from the owner or occupant of the private property.
2. Any person using that private property for hunting, fishing or trapping shall comply with the provisions of NRS 207.220.
05
NAC 501.200 3. A person who is convicted of committing a wildlife violation within 60 months after a conviction for the same violation will be assessed double the amount of demerit points listed in the schedule set forth in subsection 1.
-demerit dates are assessed on the date of conviction (NRS 501.1814(2))
06
Because the language for hunter trespass is in NRS, we cannot change that language until interest is taken forward during a legislative session
Hard to delineate intentional and unintentional with the current hunter trespass language
Refers to NRS 207.200 ONLY for “warning” (posting) for trespass, not with intention to vex, annoy, or commit a crime.
Misdemeanor crime=must happen in our presence or private citizen signs citation
07
Regulation THERE IS NO REGULATION ON HUNTER TRESPASS, other than in demerit points
08
Revocation minimum for 2 years upon conviction of damage of property If the commission chooses to go forward with draft CGR and 12 demerit points, the Department can revoke a person for up to 3 years=loss of bonus points
If the commission chooses not to allow 12 demerit points for destruction of private property, we have no mechanism that allows us to revoke someone for 2 years or take bonus points away
Guides already have a stipulation in the guide law of conviction of trespass NDOW may revoke.
Areas closed to hunting and trapping
To include private property legally marked per NRS 207.200 without permission
Include destruction of WMA, not just private property
