ORDER On April 8, 2010, the Board received from LIJO, Inc. (contractor) a notice of appeal seeking payment of $2988.61 for the repair of damages to buses leased to the respondent, the Environmental Protection Agency (Government), under contract EP-D-06-064. The contracting officer had not issued a decision on the underlying claim. Government counsel assisted in obtaining a review of the claim; the contracting officer has determined that the claim should be granted. The parties have executed a contract modification, settling the dispute, covering the amount of the claim. On June 2, 2010, the Board received from the contractor a request for a dismissal with prejudice. The appeal is DISMISSED WITH PREJUDICE. SEPH A.
