Special characteristics of nuclear-related information include:
No automatic declassification
Limited authority to determine initial classification and declassification
Special training for access and classification
Special marking
Special access requirements for RD
Foreign exchange of RD and FRD is only permitted under special agreements 4<br>

5 Restricted Data Restricted Data (RD) is data concerning the:
(1) Design, manufacture, or utilization of atomic
weapons;
The production of special nuclear material; or
(3) The use of special nuclear material in the production of energy
but does not include data declassified or removed from the Restricted Data category (e.g., Formerly Restricted Data or Transclassified Foreign Nuclear Information)<br>

6 Is all nuclear-related information RD? Initially all nuclear-related information was RD, now that is no longer the case
Some information has been declassified, for example:
Civilian Reactors
Biological effects
Some information has been transclassified to
FRD
TFNI<br>

7 What is transclassification? Section 142 of the AEA permits moving information from the RD category to other nuclear-related classification categories under certain circumstances
The process of moving information from the RD category into another classification category under Section 142 is referred to as TRANSCLASSIFICATION<br>

9 What is TFNI? Classified information that was once RD, but DOE and the Intelligence Community jointly decided it should be transclassified to TFNI in order to more easily share information concerning foreign nuclear programs for intelligence-related purposes<br>

11 Is TFNI new? Some things are old…
Transclassified intelligence-related information concerning foreign nuclear programs has existed since first authorized in the Atomic Energy Act of 1954, as amended
This information used to be considered NSI and was always exempted from automatic declassification (e.g., 25X2)
And some things are new…

Authorities, responsibilities, and requirements are now identified in 10 CFR 1045<br>

12 What do persons with access to matter containing TFNI need to know?<br>

Your responsibility – Generating New Matter If you generate matter that potentially contains TFNI, you must have it reviewed by a person who is trained to classify matter containing TFNI 13<br>

Your responsibility – Existing Matter You must also consult a person trained to classify TFNI if you want to remove TFNI from portion marked matter that is not for public release or to downgrade the level of TFNI contained in matter 14<br>

What information is potentially TFNI? TFNI is classified information concerning foreign nuclear programs
Examples of potential subject areas:
Foreign weapon design
Foreign enrichment programs
Foreign nuclear submarine reactors
Not all foreign nuclear information and information on all foreign programs is TFNI, so make sure to consult a trained person 15<br>

16 Who can determine if matter contains TFNI? Only a person with specific training may review matter to determine if it contains TFNI
Even if a person is trained and authorized to mark matter containing NSI (e.g., Confidential, Secret, Top Secret), they must have additional training to determine if the matter contains TFNI
Even if a person is authorized to review matter to determine if it contains RD or FRD (RD Derivative Classifier), they must have additional training to determine if matter contains TFNI<br>

Review of Matter Containing TFNI When a trained person reviews matter that potentially contains or is marked as containing TFNI, they will determine if they can review the matter or if it must be coordinated with DOE
If they are authorized to review the matter, they will determine if it contains TFNI and take the appropriate action
If they are not authorized, they may advise you how to obtain a review, refer you to your agency procedures, or to your RD Management Official 17<br>

18 Who can redact TFNI from a portioned marked document? Only a person with specific training may create matter that does not contain TFNI by redacting the portions marked as containing TFNI
If matter is for public release or is not portion marked, only DOE has the authority to redact TFNI portions<br>

19 Who can downgrade matter containing TFNI? Only a person with specific training can downgrade the level of TFNI matter (e.g., S//TFNI to C//TFNI)
Only DOE is authorized to downgrade the category/remove TFNI markings from matter so it can be handled as NSI (e.g., S//TFNI to Secret)<br>

20 Who can declassify TFNI? TFNI is never automatically declassified
If you have matter that may contain TFNI, even if it has a declassification date or event, you must not declassify it
Only DOE is authorized to declassify TFNI. (If there are other equities in the matter, DOE will remove the TFNI designation and defer declassification to the appropriate agency)<br>

21 How do I recognize matter containing TFNI? When matter contains TFNI and no RD/FRD
Page/banner marking contains level and category
Portion marking contains the category
The “Declassify on:” line must indicate the matter is not subject to automatic declassification (e.g., N/A to TFNI) Markings are for example purposes only.<br>

22 What should I do if I think TFNI is not properly classified? Any person with access to TFNI who believes that TFNI is improperly classified is encouraged and expected to challenge the classification
A challenge may be submitted according to agency procedures to the RD Management Official or directly to the Director, Office of Classification, at any time
There is no retribution for challenges<br>

23 Who can have access to TFNI? Must have a need to know the information
DOE “Q” or “L” access authorization is not required
Same access requirements as for classified information that is not RD<br>

24 Are there special handling requirements for TFNI? TFNI is stored, transmitted, and destroyed the same as NSI of the same level
Unlike RD and FRD, TFNI is treated the same as NSI in foreign transmission<br>

Do you need to classify matter containing TFNI? If you need to classify matter containing TFNI, you must also complete Module 2 25<br>
