Medical Power of AttorneyThe Medical Power of Attorney springs into effect when Principal is incompetent and attending physician certifies in writing that Principal is no longer able to make health care decisions. TMB - Get Your House In Order Adv. Directives 4

What is a durable power of attorney? A durable power of attorney is a written document which allows the principle to select a person or persons to act on their behalf whether the principle is unable to do so on their own or not. What is the purpose of a Will?A will allows you to transfer your property at your death and will need to go through the court system, (probate) to determine the legalities of the will and the properties being dispersed. TMB - Get Your House In Order Adv. Directives 6

Directive to Physicians and Family or SurrogatesMain purpose of the Directive to Physicians is for the declarant to directly inform the physician whether the declarant does or does not want life-sustaining procedures used if the declarant is in an irreversible or terminal condition. What is the purpose of a Trust?A Trust is a transfer of all your property, assets, bank accounts, securities, real estate to a “Trust”. You no longer own these assets, the “Trust” does. You still have access to all these assets while you are alive. You can instruct your Trust to pay out all income to you during your lifetime, and on your death whatever is left would go to your beneficiaries. You can put instructions in the Trust as to who has access to it. Difference between a Trust and a Will is with a Trust, your property will avoid probate after you die.
