No.11.][2006.]CriminalLaw(Insanity)Actconditionofthepatientgivenbytheconsultantpsychiatristrespon-sibleforhisorhercareortreatment,determinethequestionwhetherornotthetreatmentreferredtoinsubsection(4)isstillrequiredinthesamemannerasifthatquestionwerebeingdeterminedpursuanttotherelevantprovisionofthisActortheDefenceAct1954,asmaybeappropriate,andshallmakesuchorderasitthinksproperinre-lationtothepatient,whetherforfurtherdetention,careortreatmentinadesignatedcentreorforhisorherdischargewhetheruncon-ditionallyorsubjecttoconditionsforout-patienttreatmentorsuper-visionorboth.(6)Wheretheclinicaldirectorofadesignatedcentreformstheopinioninrelationtoapatientdetainedpursuanttosection5section203oftheDefenceAct1954,thatheorsheisnolongerinneedofin-patientcareortreatmentatadesignatedcentreheorsheshallforthwithnotifytheReviewBoardofthisopinion.(7)WheretheReviewBoardreceivesanotificationundertion(6),itshallorderthatthepatientbebroughtbeforeit,assoonasmaybe,andshall,havingheardevidencerelatingtothementalconditionofthepatientgivenbytheconsultantpsychiatristrespon-sibleforhisorhercareortreatment,determinethequestionwhetherornotthetreatmentreferredtoinsubsection(6)isstillrequiredandshallmakesuchorderasitthinksproperinrelationtothepatient,whetherforfurtherdetention,careortreatmentinadesignatedcentreorforhisorherdischargewhetherunconditionallyorsubjecttoconditionsforout-patienttreatmentorsupervisionorboth.(8)Apatientdetainedpursuanttosection4ortosection202oftheDefenceAct1954,mayapplytotheReviewBoardforareviewofhisorherdetentionandtheReviewBoardshall,unlesssatisfiedthatsuchareviewisnotnecessarybecauseofanyreviewundertakeninaccordancewiththissection,orderthatthepatientbebroughtbeforeit,assoonasmaybe,and—)if,havingheardevidencerelatingtothementalconditionofthepatientgivenbytheconsultantpsychiatristrespon-sibleforhisorhercareortreatment,theReviewBoarddeterminesthatheorsheisnolongerunfittobetriedbyreasonofmentaldisorderortoparticipateinproceedingsreferredtoinsection4itshallorderthatthepatientbebroughtbeforethecourtwhichcommittedhimorhertothedesignatedcentretobedealtwithasthatcourtthinksproperorinthecaseofapatientdetainedpursuanttosection202oftheDefenceAct1954,itshallnotifyacon-veningauthority(withinthemeaningofChapterVoftheDefenceAct1954)andtheconveningauthorityshallconveneacourt-martialwhichshallorderthatthepatientbebroughtbeforeittobedealtwithasthecourt-martialthinksproper,or)iftheReviewBoarddeterminesthatthepatient,althoughstillunfittobetriedisnolongerinneedofin-patientcareortreatmentatadesignatedcentre,theReviewBoardmaymakesuchorderasitthinksproperinre-lationtothepatient,whetherforfurtherdetention,careortreatmentinadesignatedcentreorforhisorherdis-chargewhetherunconditionallyorsubjecttoconditionsforout-patienttreatmentorsupervisionorboth.(9)Apatientdetainedpursuanttosection5ortosection203oftheDefenceAct1954,mayapplytotheReviewBoardforareviewofhisorherdetentionandtheReviewBoardshall,unlesssatisfied [2006.][CriminalLaw(Insanity)Actthatsuchareviewisnotnecessarybecauseofanyreviewundertakeninaccordancewiththissection,orderthatthepatientbebroughtbeforeit,assoonasmaybe,andshall,havingheardevidencerelatingtothementalconditionofthepatientgivenbytheconsultantpsy-chiatristresponsibleforhisorhercareortreatment,determinethequestionofwhetherornotthepatientisstillinneedofin-patienttreatmentinadesignatedcentreandshallmakesuchorderasitthinksproperinrelationtothepatientwhetherforfurtherdetention,careortreatmentinadesignatedcentreorforhisorherdischargewhetherunconditionallyorsubjecttoconditionsforout-patienttreatmentorsupervisionorboth.(10)TheReviewBoardmayonitsowninitiativereviewthede-tentionofapatientdetainedpursuanttosection4ortosection202or203oftheDefenceAct1954,andsubsection(8),asappropriate,shallapplytosuchreviewasifthepatienthadappliedforthereviewunderthesubsectionconcerned..—(1)Theclinicaldirectorofadesignatedcentremay,withtheconsentoftheMinister,directthetemporaryreleaseofapatientonsuchconditionsandforsuchperiodorperiodsastheclinicaldirectordeemsappropriate.(2)Theclinicaldirectorofadesignatedcentremay,withthecon-sentoftheMinisterandtheMinisterforHealthandChildren,directthetransfertoanotherdesignatedcentreofapatientonsuchcon-ditionandforsuchperiodorperiodsastheclinicaldirectordeemsappropriatewiththeconsentoftheclinicaldirectoroftheother(3)Wherethereleaseortransferofapatientundersubsection(1)ismadesubjecttoconditions,theconditionsshallbecommuni-catedtothepatientbynoticeinwritingatthetimeofhisorherreleaseortransfer.(4)Apatientwhosetemporaryreleaseortransferisdirectedunderthissectionshallcomplywithanyconditionstowhichhisorherreleaseortransferismadesubject.(5)Apatientwho,byreasonofhavingbeentemporarilyreleasedfromadesignatedcentre,isatlargeshallbedeemedtobeunlawfullyatlargeif—)theperiodforwhichheorshewastemporarilyreleasedhasexpired,or)aconditiontowhichhisorherreleasewasmadesubjecthasbeenbroken.(6)Where,byreasonofthebreachofaconditiontowhichhisorherreleasewasmadesubject,apatientisdeemedtobeunlawfullyatlargeandisarrestedundersubsection(7)orotherwiseorreturnsvoluntarily,theperiodforwhichheorshewastemporarilyreleasedshallthereuponbedeemedtohaveexpired.(7)Withoutprejudicetoanyotherpowerconferredbylaw,amemberoftheGardaSnashall,oranofficerorservantofthedesignatedcentremay,arrestwithoutwarrantanypersonwhomheorshesuspectstobeunlawfullyatlargewhilesubjecttoanorderforhisorherdetentioninadesignatedcentreunderthisActandbringhimorherbacktosuchcentre.Temporaryrelease,transferandother AmendmentofDefenceAct1954.1954.No.11.][2006.]CriminalLaw(Insanity)Act.—TheDefenceAct1954,isherebyamendedbythesubstitutionforsections202,203and203Athereofofthefollowingsections:disorderattimeoftrial.202.—(1)Whereatthetrialbycourt-martialofapersonchargedwithanoffenceitappearsthatsuchpersonisbyreasonofmentaldisorderunfittotakehistrialthefollowingprovisions,subjecttosubsection(4),shallhaveeffect,thatistosay:)thecourt-martialshallfindspeciallythatfact,)thecourt-martial,ifitissatisfiedhavingheardevidencerelatingtothementalconditionofthepersongivenbyacon-sultantpsychiatristthatsuchpersonissufferingfromamentaldisorder(withinthemeaningoftheActof2001)andisinneedofin-patientcareortreatmentinadesignatedcentre,shallcommithimtoaspecifieddesig-natedcentreuntilanorderismadesection13oftheCriminalLaw(Insanity)Act2006(2)Afindingunderthissectionshallnotre-quireconfirmationorbesubjecttorevision.(3)Apersonchargedwithanoffenceshallnotbefittotakehistrialifheisunablebyreasonofmentaldisordertounderstandthenatureorco-urseoftheproceedingssoasto—)pleadtothecharge,)instructalegalrepresentative,)makeaproperdefence,or)understandtheevidence.(4)Afterthecourt-martialhasfoundthatapersonchargedwithanoffenceisunfittotakehistrial,itmayonapplicationtoitandwithoutpreju-dicetoanyfurtherproceedingsallowevidencetobeadducedbeforeitastowhetherornotthatper-sondidtheactormadetheomissionallegedagainsthimandifthecourt-martialissatisfiedthatthereisareasonabledoubtthatthepersoncom-mittedthatactormadetheomissionitshallac-quithim.(5)Inthissectionandinsection203ofthisAct‘mentaldisorder’and‘designatedcentre’shallhavethemeaningsrespectivelyassignedtothemsection1oftheCriminalLaw(Insanity)Act,unlessthecontextotherwiserequires.disorderattimeofcommissionof203.—(1)Whereatthetrialbycourt-martialofapersonchargedwithanoffence,thecourt-martialfindsthatthepersondidtheactormadetheomissionchargedbut,havingheardevidence [2006.][CriminalLaw(Insanity)Act8.IfamemberoftheReviewBoarddies,resigns,becomesdis-qualifiedorisremovedfromoffice,theMinistermayappointanotherpersontobeamemberoftheReviewBoardtofillthecasualvacancysooccasionedandthepersonsoappointedshallbeap-pointedinthesamemannerasthememberoftheReviewBoardwhooccasionedthevacancyandshallholdofficefortheremainderofthetermofofficeforwhichhisorherpredecessorwasappointed.9.TheMinistermayappointsuchandsomanypersonstobemembersofthestaffoftheReviewBoardasheorsheconsidersnecessarytoassisttheReviewBoardintheperformanceofitsfunc-tionsandsuchmembersofthestaffoftheReviewBoardshallholdtheirofficesoremploymentonsuchtermsandsubjecttosuchcon-ditionsandreceivesuchremunerationastheMinistermay,withtheconsentoftheMinisterforFinance,determine.10.MembersofthestaffoftheReviewBoardshallbecivilser-vantswithinthemeaningoftheCivilServiceRegulationAct1956.11.TheReviewBoardshallholdsuchsittingsasmaybenecessaryfortheperformanceofitsfunctionsunderthisAct.12.EveryquestionatasittingoftheReviewBoardshallbedeter-minedbyamajorityofthevotesofthemembersvotingontheques-tionand,inthecaseofanequaldivisionofvotes,thechairpersonshallhaveacastingvote.13.SubjecttotheprovisionsofthisSchedule,theReviewBoardshallestablishitsownrulesofprocedure.
