PURPOSE

To present and consult with the Portfolio and Select Committees on the potential candidates for appointment to serve on the National

Council for Correctional Services (NCCS) as public representatives in line with the requirements of Section 83(3)(h) of the Correctional Services Act, 1998 (Act No 111 of 1998) 3Slide4

BACKGROUND

In

terms of Section 83 of the Correctional Services Act, Act 111 of 1998, the Minister must appoint a National Council for Correctional Services (NCCS). The primary function of the NCCS is to advise the Minister in developing policy with regard to the correctional system and the sentencing process. In terms of Section 77 of the Correctional Services Act, Act 111 of 1998, the NCCS is also acting as the Correctional Supervision and Parole Review Board to review Correctional Supervision and Parole Board (CSPB) decisions. 4Slide5

STATUTORY REQUIREMENTS

In terms of Section 83(2)(h) of the Correctional Services Act, Act 111 of 1998, as amended, the Minister must appoint four or more persons, not in the full-time service of the State, appointed as representatives of the Public in consultation with the relevant Parliamentary Committees.

CALL FOR NOMINATIONS

Chronological

exposition of the process followed:21 February 2016An advert was placed in the Sunday media calling for nominations for persons to serve on the NCCS as required by the Act. The closing date for the call for nominations was 7 March 2016. Only fifteen (15) Curriculum Vitae’s were received. 5 April 2016The call for nominations was re-advertised with a closing date of 15 April 2016. A total of twenty seven (27) persons applied.The total number of applications/nominations received was therefore forty two (42).

Of the forty two (42) applications, ten (10) were from existing members.6Slide7

CONSULTATION

Chronological exposition of the process followed:

11 and 12 May 2016Letters were sent to both Chairpersons of the Portfolio and Select Committees requesting inputs regarding the preliminary list of proposed candidates. Following this consultation process inputs were received and considered.7Slide8

CRITERIA USED TO SHORTLIST POTENTIAL

CANDIDATES

1 Basic criteria 1.1 Candidate was nominated. 1.2 Candidate accepted the nomination. 2. Candidate not in fulltime service of the state; or 3. Experts in clinical psychology; or 4.

Representative of non-governmental organizations working within the field of Correctional Services; or 5. Academics with expertise in criminal law, criminology, penology or restorative justice;

or

 

Experts

in community justice.

Gender, transformation and skills transfer imperatives.

Inputs from preliminary consultation process.

POTENTIAL CANDIDATES

Based

on the applications and the selection criteria met, Minister proposes the following potential candidates for appointment on the NCCS. 1 Experts in clinical psychology 1.1 Mr I L de Klerk Mr De Klerk has a Masters in Psychology from the University of Free State. He is currently in private practice. Experience: 

Unitas Hospital : Radiographer assistant (December 2003 – June 2006)Vista Clinic : Reintegration centre, Ward Administrator (June 2005 – August 2008)

Synovate SA : Junior Research Executive (September 2008 – January 2009

Weskoppies Psychiatric Hospital : Clinical Psychology Intern (January 2010 – December 2010)Department of Correctional Services : Clinical psychologist (January 2011 – April 2014)He has been appointed as a member of the NCCS as from 1 June 2015 for a period of twelve (12) months.10Slide11

1.2 Ms T S Monyamane Ms Monyamane has a Masters in Clinical Psychology from the University of Johannesburg. She is an independent practitioner.  Experience: The South African Depression and Anxiety Group: Telephonic Counselling, Rural Outreach, Schools programme – Teen Suicide Prevention and Presentations on depression, anxiety and suicide to old age homes, Hospice and palliative care associations and Mental healthcare and other healthcare professionals (2005 -2008).

The Smile Foundation: Responsible for Parents’ workshops, nurses debriefing workshop, counselling for vulnerable at-risk children and caregivers, patient support during smile (surgery) week (November 2012 to date). She has been appointed as a member of the NCCS as from 1 June 2015 for a period of twelve (12) months.

1.3 Ms L U Z RataemaneMs Rataemane has an M Phil in Health Psychology from the University of Surrey, Guildford, UK and an MSc in Clinical Psychology from the same institution.Experience: She is a qualified clinical psychologist and self-employed.In view of the priority areas on which the NCCS should focus it is felt that due to vast and extensive experience as a clinical psychologist and NCCS member she can continue to add value to this Council.

Ms Rataemane will therefore reinforce the psychological expertise which I feel is particularly critical for the function of the NCCS.She was an active member of the NCCS from 2010 – 2015.

2. Representative of non-governmental organizations working within the field of Correctional Services2.1 Adv. K A Mahumani Adv. Mahumani has a Masters of Law (LLM) degree from the University of the North and Potchefstroom University.  Adv.

Mahumani is a retired magistrate and is currently serving as the Chairperson of CONTRALESA. This organization has previous experience working with various government departments and institutions, including the Department of Correctional Services where they assist with the various community service initiatives for the benefit of parolees.

Adv. K A Mahumani: Cont.Experience: Clerk of the Court (1977 – 1980).Court Interpreter (1981 – 1982).Public Prosecutor (1983 – 1987).Magistrate (Head of Office) Modimolle (1988 – 2000).Senior Magistrate of Modimolle Region (2000 – May 2015).

2. Representative of non-governmental organizations working within the field of Correctional Services2.2. Rev J P Clayton Rev Clayton has an Theological Studies (Four years) Baptist Seminary, Cape Town and a Restorative Justice International Diploma from the Queens University in Canada. He has also done a number of rehabilitation programmes with the Department of Correctional Services.

Experience:Rev Clayton had been considered a strong candidate under the Category NGO’s involved in Correctional Systems.

He is an ex-offender and currently the Executive Director of Hope Prison Ministry.

He is actively involved in Restorative Justice and Victim Offender Dialogue.

The fact that he was previously incarcerated and has been a law abiding citizen since 1991 he will bring a meaningful perspective to engagements on the value of rehabilitation and restorative justice.

3.1 Ms A VilakaziMs Vilakazi has a Bachelor of Laws (LLB) Degree from the University of Johannesburg. She is currently a practising attorney and Director of Buthelezi Vilakazi Inc. She specializes in Criminal Law, Labour matters, Family Law, Evictions and Deceased Estate. Experience: She attended to High Court, Magistrate Court, Labour Court, Bargaining Council and CCMA litigation:

Attended to both high court and magistrate court litigation on behalf of various Europ Assistance Pty Ltd clients, Europ Assistance (Pty)Ltd as a legal cost insurance provider enlisted Amanda Vilakazi attorneys services on behalf of their client for purposes of legal advice, legal opinion, litigation and general legal services.16Slide17

Experience Represented South African Building and Allied Workers Union (SABAWO) in an application before the Labour Court for an order to have the trade unions name reinstated into the register of trade unions and to overturn the decision of the labour registrar in cancellation of the trade’s union registration in terms of section 111 of the Labour Relations Act. Rendered employment law services to Shapla investments (Pty) Ltd. Advised client on restructuring exercise, on section 197 arrangements, on employment equity, affirmative action and discrimination disputes as well as litigation and strategic advice on those issues.Drafting of contracts of employment and resolution of disputes on those contracts and fixed term contracts.

Attended to labour court reviews and appeals in the various courts.Represented client at the CCMA and Bargaining Council in unfair dismissal disputes.

Experience Drafting, interpreting of and advising clients on disciplinary codes and advice on all Labour statutes including the BCEA, EEA, Protected Disclosures Act, Pension Funds Act and Workmen Compensation Act.Dealt with incapacity disputes and litigation for client and general employment law advice.Attended to debt review for client, our debt review department provides the following services to the consumer and to credit provider:- Advise & litigation on reckless credit agreements, advise & litigation on debt restructuring, attending to section 86(10) notices, attending to section 129 notices, attending to sequestration litigation.

ChettyDr Chetty holds has a Doctorate in Criminology from the University of Durban-Westville. Dr Chetty is a retired lecturer from the University of Durban Westville.Experience: She has more than thirty one (31) years’ experience as a lecturer in the field of Criminology. She has participated in various organizations throughout her career, including but not limited to: South African Society for the Prevention of Child Abuse and Neglect.Advice Desk for Abused Women.
