1 2018/2019 MFMA OUTCOMES Report of the MEC responsible for Local Government In terms of section 131 of the MFMA Presentation AUGUST 2020 GROWING KWAZULU-NATAL TOGETHER 2 GROWING KWAZULU-NATAL TOGETHER Table of Contents PART 1: CAUSE OF FIRE BACKGROUND AND PURPOSE 2 The Auditor-General (AG) presented the KZN summary of the MFMA outcomes in respect of the municipalities in the Province to the TROIKA comprising the Honourable Premier and MECs for Cooperative Governance and Traditional Affairs and Finance. The General Report of the AG has also been tabled in the National Legislature in respect of all Provinces. The MEC for Local Government is required to report to the Provincial Legislature on the MFMA audit outcomes of municipalities in KwaZulu-Natal. 3 GROWING KWAZULU-NATAL TOGETHER Table of Contents PART 1: CAUSE OF FIRE LEGISLATIVE MANDATE 3 Municipal Finance Management Act SECTION 131. ISSUES RAISED BY THE AUDITOR GENERAL IN AUDIT REPORTS (2)The MEC for local government in the province must – (a) Assess all annual financial statements of municipalities in the province, the audit reports on such statements and any responses of municipalities to such audit reports , and determine whether municipalities have adequately addressed any issues raised by the Auditor-General in audit reports; and (b)Report to the provincial legislature any omission by a municipality to adequately address those issues within 60 days. Given the MFMA conditional exemption granted by National Treasury (Circular 99) and the uplifting of the limitation on sittings of municipal councils through virtual meetings by the National Minister on 07 May 2020, municipalities must comply by 07 June 2020 (ie within 30 days) MEC has subsequently complied with submission to the Provincial Legislature by the extended timeline of 07 August 2020. 4 GROWING KWAZULU-NATAL TOGETHER Table of Contents PART 1: CAUSE OF FIRE SECTION 131 REPORT OBJECTIVES 4 The primary purpose of this report is for the Member of the Executive Council (MEC) of KwaZulu-Natal responsible for Local Government as defined in the legislation, the MEC for Cooperative Governance and Traditional Affairs (COGTA) to report to the Provincial Legislature any omissions by municipalities to adequately address issues raised by the Auditor-General in municipal audit reports as required in terms of section 131(2)(b) of the Municipal Finance Management Act, No 56 of 2003 (MFMA). The secondary objective of this report is for the Member of the Executive Council of KwaZulu-Natal to report to the Provincial Legislature on the analysis
