slide2. Convention on International Trade in Endangered Species of Wild Fauna and Flora NDFs in CITES: Provisions of the Convention Export/Import
Export of any specimen of a species included in Appendix I (II) shall require the prior grant and presentation of an export permit. An export permit shall only be granted when the following conditions have been met:
A Scientific Authority of the State of export has advised that such export will not be detrimental to the survival of that species; …
Introduction from the Sea
The introduction from the sea of any specimen of a species included in Appendix I (II) shall require the prior grant of a certificate from a Management Authority of the State of introduction. A certificate shall only be granted when the following conditions have been met:
A Scientific Authority of the State of introduction has advised that the introduction will not be detrimental to the survival of the species involved; … Import of any specimen of a species included in Appendix I shall require the prior grant and presentation of an import permit and either an export permit or a re-export certificate. An import permit shall only be granted when the following conditions have been met:
A Scientific Authority of the State of import has advised that the import will be for purposes which are not detrimental to the survival of the species involved; … Roles in the ecosystems
A Scientific Authority in each Party shall monitor both the export permits granted by that State for specimens of species included in Appendix II and the actual exports of such specimens. Whenever a Scientific Authority determines that the export of specimens of any such species should be limited in order to maintain that species throughout its range at a level consistent with its role in the ecosystems in which it occurs and well above the level at which that species might become eligible for inclusion in Appendix I, the Scientific Authority shall advise the appropriate Management Authority of suitable measures to be taken to limit the grant of export permits for specimens of that species.<br>

An NDF is the result of a science-based assessment
SAs should consider whether the species would be maintained throughout its range at a level consistent with its role in the ecosystems in which it occurs
SA’s should consider the volume of legal and illegal trade (known, inferred, projected, estimated) relative to the vulnerability of the species (intrinsic and extrinsic factors that increase the risk of extinction of the species)
data requirements for a determination that trade is not detrimental to the survival of the species should be proportionate to the vulnerability of the species concerned
the methodology used to make a NDF should reflect the origin and type of specimen, such that the method used to make a NDF for a specimen known to be of non-wild origin may be less rigorous than that for a specimen of wild origin
the methodology used should be flexible enough to allow for consideration of the specific and individual characteristics of different taxa
the implementation of adaptive management, including monitoring, is an important consideration in the making of an NDF
the NDF is based on resource assessment methodologies which may include a variety of relevant factors
NDFs may take a variety of relevant sources of information into account<br>

make new or updated NDF guidance available to CITES Parties that export specimens of CITES-listed species

Definition and scope of workstreams to address the gaps and weaknesses in NDF guidance materials as identified in document AC31 Doc. 14.1/PC25 Doc. 17, its Addendum and in document AC31/PC25 Com. 3;
Draft most appropriate ways to address each identified workstream;
Content, agenda and conduct of the international expert workshop on NDF guidance;
Guidance materials on NDFs that are to be prepared for review at the workshop;
Finalization and dissemination of the workshop outputs; and the
Development of a strategy and feedback mechanism for Parties and the wider CITES community to share experiences with using NDF guidance materials.

slide10. CITES NDF Project: Phase 2 - Draft Guidance Workstream Expert Groups and Compilation Convention on International Trade in Endangered Species of Wild Fauna and Flora Workstream expert groups (WEGs) set up: November 2022 to February 2023
Preparation of draft guidance: March to August 2023 (no less than two meetings per workstream to define the content of draft guidance to address gaps)
Workstream expert groups submitted draft guidance in August 2023 in various degrees of finalization and diverse formatting and editorial styles. Secretariat and IUCN compiled draft guidance, to:
Ensure basic consistency of formatting and editing;
Remove duplications;
Enhance the logical flow and rearrange sections – incl. rearrangement of Modules 1 and 2;
Ensure alignment with relevant provisions of the Convention, and with definitions and stipulations previously adopted in Resolutions; and
Amendments to the draft guidance on Appendix I import NDFs (module 4).
