CYBER LAW IN INDIA In Simple way we can say that cyber crime is unlawful acts wherein the computer is either a tool or a target or both Cyber crimes can involve criminal activities that are traditional in nature, such as theft, fraud, forgery, defamation and mischief, all of which are subject to the Indian Penal Code. The abuse of computers has also given birth to a gamut of new age crimes that are addressed by the information Technology Act, 2000. We can categorize cyber crimes in two ways The Computer as a Target : using a computer to attack other computers. e.g. Hacking, Virus/Worm attacks, DOS attack etc. The computer as a weapon : using a computer to commit real world crimes. e.g. Cyber Terrorism, IPR violations, Credit card frauds, EFT frauds, Pornography etc Cyber Crime regulated by Cyber Laws or Internet Laws. Cyber Law of India : Introduction “The modern thief can steal more with a computer than with a gun. Tomorrow’s terrorist may be able to do more damage with a keyboard than with a bomb” National Research Council, U S A “Computers at Risk” (1991) Cyber Law is the law governing cyber space. Cyber space is a very wide term and includes computers, networks, software, data storage devices (such as hard disks, USB disks etc.), the Internet, websites, emails and even electronic devices such as cell phones. ATM machines etc. What is Cyber Law ? Cyber Crimes Electronic and Digital Signatures Intellectual Property Data Protection and Privacy. Cyber law of India encompasses laws relating to Cyber crime is the latest and perhaps the most complicated problem in the cyber world. Cyber crimes are unlawful acts where computer is used either as a tool; or a target; or both. The enormous growth in electronic commerce (e-commerce) and online share trading has led to phenomenal spurt in incidents of cyber crime. What is Cyber Crime Cybercrimes against persons Cybercrimes against property Cybercrimes against government Cybercrimes can be basically divided into three major categories : Cybercrimes committed against persons include various crimes like transmission of child – pornography, harassment of any one with the use of a computer such as e-mail. The trafficking, distribution, posting, and dissemination of obscene material including pornography and indecent exposure, is one the most important Cybercrimes known today in general. Cyber crime against persons These crimes include : Computer vandalism (destruction of other’s property);
