The Rules of Business, 1996 Presented by: Md. Ashraf Shameem Additional Secretary Cabinet Division Introduction: The Rules of Business (RoB) are a set of procedural imperatives that require compliance in allocation and transaction of business of the government. ‘Business’, as defined in the RoB, is ‘all work done by the government’ Art. 65(1) There shall be a Parliament for Bangladesh (to be known as the House of the Nation) in which, subject to the provisions of this Constitution, shall be vested the legislative powers of the Republic: Provided that nothing in this clause shall prevent Parliament from delegating to any person or authority, by Act of Parliament, power to make orders, rules, regulations, bye-laws or other instruments having legislative effect. Art. 55(6) The President shall make rules for the allocation and transaction of the business of the Government. Legal Back-up The Rules of Business was an inseparable part of government transaction even during the British India. The Government of India Act, 1935 authorised the Governor General to “make rules for the convenient transaction of the business” ‘The Rules of Business’ for the Government of Bengal was framed on 30th may 1946. The government of the East Bengal framed the ‘Rules of Business’ on 1st July 1954 in independent Pakistan under the same act. The government of Pakistan had it’s Rules of Business in 1962. Under the new constitution. Historical Perspective 1/2 After independence, The Bangladesh (Transaction of Government Business) Order known as the Presidential Order 58 was promulgated in 1972 to have temporary provision for government transactions. This Presidential Order was later repealed following adoption of the Constitution on 16 December 1972 [Art 151(h)]. During 1972 to 1975, in absence of a framed Rules of Business the President could set forth such rules as authorized by the Constitution. The first Rules of Business was issued on Nov 1, 1975. The present Rules of Business was issued on 19 Oct 1996. Historical Perspective 2/2 The Rules of Business has two major parts: 1) The main text of the Rules of Business and ; 2) Allocation of Business among the Different Ministries and Divisions (Schedule I of the Rules of Business, 1996). It has 5 chapters with 33 rules and 7 schedules. Features Chapters The Rules of Business has 7 schedules.
