Code For The Re-Siting Of Dwelling Houses (Code 9) (D&E)Adopted: Ord 1/5/89 Amended: Responsible Division: Development & Environment Services Re-siting: Means the removal of a building from one site and its relocation on another site. Immediate Vicinity: Means the area bounded by the site to which a building is to be resited and includes the two sites either side, the five sites immediately opposite and the five sites immediately to the rear of the subject site. 1. A building shall not be re-sited without the approval of Council. 2. Where Development Consent is required to erect a building on land, no building shall be re-sited on that land without Development Consent having been obtained beforehand. 3. No building shall be re-sited without a Building Permit having been obtained beforehand. 4. Where Development Consent is required, an application shall be lodged and the appropriate fee paid. 5. A Building Application must be accompanied by at least two (2) copies of plans drawn to scale showing the building, together with any additions or alterations proposed. A photograph of the building must accompany the application. 6. Where the building is to be moved from a site within the Hastings area, an application to remove/demolish the building must be made and the appropriate fee and security deposit paid. 7. A building may only be re-sited if its design and/or construction is in keeping with existing dwellings already erected in the area to which it is to be re-sited. 8. The following criteria will be used in determining an application to re-site a building: (a) Where more than 50% of dwellings in the immediate vicinity of a lot, which is the subject of an application are brick or brick veneer, the re-sited building shall be brick veneered, have its roof tiled and be renovated. (b) Where less than 50% of the dwellings in the immediate vicinity of the lot, which is the subject of an application, are timber or AC clad, the re-sited building may retain its original features but shall be painted and restored to good condition, or reclad with suitable material prior to occupation. (c) Where it is intended to re-site a building in an area to which Clause 8(a) applies and the applicant does not intend to brick veneer the building, the application will be submitted to Council after inform of lots in the immediate vicinity of the application and their rights to submit comments with respect to the proposal. 9. This Code applies to all residential and rural residential subdivisions.
