(write the words "lu et approuvé" before your signature) www.gites-de-france-haute-savoie.comGîtes de France Haute-Savoie RENTAL CONTRACT FOR GÎTE RENTED DIRECTLY FROM OWNER(S) This document is NOT an invoice SALES TERMS AND CONDITIONS Article 1 – This holiday rental contract is only intended for use with gîtes which have received Gîtes de France de Haute-Savoie accreditation, on behalf of the Fédération Nationale des Gîtes de France. The Fédération Nationale des Gîtes de France and Gîtes de France de Haute-Savoie may in no case be held liable for the use of this contract by third parties or for purposes other than tourism. Article 2 – Length of stay: the client, signatory to this rental contract which specifies a given length of stay, may in no circumstances claim the right to remain in the property at the end of the holiday let. Article 3 – Finalising the contract: the reservation is confirmed when the client sends the owner, before the date specified overleaf, a deposit of between 25% to 50% of the total amount due and one signed copy of the contract. The second such copy is retained by the client. The rental contract signed by the two parties (owner and client) cannot be transferred, even partially, to a third party, person or legal entity, without the owner’s written agreement. Any breach of this clause can result in the immediate cancellation of the rental contract, to the exclusive cost of the client as the owner is entitled to retain all rental income received. Article 4 - No retraction: for reservations made by letter, telephone or the Internet, the client has no right of retraction, pursuant to article L121-20-4 of the Consumer Code relating in particular to accommodation services provided at a given date or according to a given frequency. Article 5 - Cancellation by the client: Any cancellation must be communicated by registered letter to the owner. a) Cancellation before the holiday begins: the owner retains the deposit paid. If you cancel less than 30 days before the agreed start date of your holiday rental, the owner is entitled to ask you to pay the balance of the total amount due. If you do not arrive within 24 hours of the agreed start date of your holiday, this rental contract is nullified and the owner is free to use/rent the gîte. He retains the deposit paid and will require you to pay the balance of the rent due. b) If you leave earlier than the agreed date, the owner retains the entire amount of rent paid. No refund is payable. Article 6 - Cancellation by the owner: the owner refunds all sums paid. You will also receive compensation at least equal to the penalty you would have owed if you had cancelled the reservation at that date. Article 7 - Arrival: you must present yourself on the day and at the time specified in the rental contract. In the event that you arrive late or your arrival is postponed you must notify the owner. Article 8 – Payment of balance : the balance owing on the rent must be paid on your arrival. Article 9 - Inventory: An inventory is drawn up jointly and signed by you and the owner when you arrive at and depart from the gîte. This inventory constitutes the sole reference in the event of a dispute regarding the condition of the property. The cleanliness of the gîte when you arrive must be indicated in the inventory. You are responsible for cleaning the premises during the rental period and before you leave. The amount of any cleaning charges is based on the calculation indicated in the enclosed details. Article 10 – Damage deposit : When you arrive, a damage deposit, the amount of which is indicated overleaf, is requested by the owner. After the inventory is drawn up jointly at the time of departure, this deposit is returned, minus the cost of restoring the property to its original condition if any damage has been caused. In the event of early departure (prior to the time specified in the contract) preventing the inventory of the property from being prepared on the same day that you leave, the damage deposit is returned by the owner within one week. Article 11 – Use of the property: you must use the rented property in a peaceful and entirely appropriate manner. Article 12 – Accommodation capacity: this rental contract is established for a maximum number of people. If the number of guests exceeds the accommodation capacity, the owner can refuse to accept the additional people. In this case, any amendment to or breaking of the contract will be deemed to have been caused by the client. Article 13 - Pets: this contract specifies whether you may or may not bring along a pet and specific conditions for pets will be given in the enclosed details. If pets are allowed, these details will specify any extra charges which may apply (rate per animal, extra damage deposit, extra cleaning charge). If pets are not allowed and you bring one or more animals with you, the owner may refuse to accept them. In no circumstances can such a refusal be deemed to be an amendment to or breaking of the contract caused by the owner and no refund is payable if you leave early. Article 14 - Insurance: you are responsible for any damage which you may cause. You must be insured by a holiday-let insurance policy covering such risks. Article 15 - Payment of charges: at the end of your stay, you must pay the owner any charges not included in the rent. Their amount is based on the calculation mentioned in this rental contract and the enclosed details. The owner will give you a receipt. Article 16 - Disputes: any complaint relating to the condition of and/or the description of the rented property must be submitted to Gîtes de France de Haute-Savoie within three days of entry into the premises.
