Background This Presentation covers the GST changes / observations/ press releases/ Tweet FAQs/ Sectoral FAQs released by CBEC since the last update on 02.09.2017. It supplements the earlier GST Updates. This presentation is based on CGST Act/Rules/ Notifications. Similar parallel provisions in State Laws may be referred to as required National Academy of Customs, Indirect Taxes and Narcotics (NACIN)2

GST Council’s 21 st Meeting at Hyderabad on 9th September, 2017 has taken major decisions pertaining to filing of returns and registration which are available athttp://pib.nic.in/newsite/PrintRelease.aspx?relid=170642 The same are discussed here in the ensuing slides3 GST Council Decision National Academy of Customs, Indirect Taxes and Narcotics (NACIN)

GST TRAN 1 ( Transitional Credit form) Earlier Provision: To be filed in 90 days with no revision Now revision allowed once The due date for submission of FORM GST TRAN-1 has been extended by one month i.e. 31 st October, 20174Transitional Credit form- TRAN 1 National Academy of Customs, Indirect Taxes and Narcotics (NACIN)

The registration for persons liable to deduct tax at source (TDS) and collect tax at source (TCS) will commence from 18 th September 2017. Timelines for returns of July, 2017 GSTR-1 ……… 10th October, 2017GSTR 2 ………. 31st October, 2017 GSTR 3 ………. 10th November, 2017Due dates for filing of the above mentioned returns for subsequent periods will be notified at a later date. Timelines for returns of July, 2017 GSTR-4 ( Composition Dealers; Quarterly Return) 18th October, 2017 ( No change) Table-4 under GSTR-4 not to be filled for the quarter July-September 2017. Requirement of filing GSTR-4A for this quarter is dispensed with.A registered person (whether migrated or new registrant), who could not opt for composition scheme, shall be given the option to avail composition till 30th  September 2017 and such registered person shall be permitted to avail the benefit of composition scheme with effect from 1 st  October, 2017. 7 Timelines - Composition Dealers National Academy of Customs, Indirect Taxes and Narcotics (NACIN)

Presently, any person making inter-state taxable supplies is not eligible for threshold exemption of Rs.20 lacs (Rs.10 lacs in special category states except J&K) and is liable for registration. It has been decided to allow an exemption from registration to persons making inter-State taxable supplies of handicraft goods up to aggregate turnover of Rs.20 lacs as long as the person has a Permanent Account Number (PAN) and the goods move under the cover of an e-way bill, irrespective of the value of the consignment. 9 Relaxation in registration to inter-state suppliers of handicrafts National Academy of Customs, Indirect Taxes and Narcotics (NACIN)

Presently, a job worker making inter-State taxable supply of job work service is not eligible for threshold exemption of Rs. 20 lacs (Rs.10 lacs in special category states except J&K) and is liable for registration.   It has been decided to exempt those job workers from obtaining registration who are making inter-State taxable supply of job work service to a registered person as long as the goods move under the cover of an e-way bill, irrespective of the value of the consignment. The issue of avoidance of 5% GST on pulses, cereals and flours, put up in unit container and bearing a registered brand name, was discussed by the GST Council. Following changes recommended –A brand registered as on 15.05.2017 shall be deemed to be a registered brand for the purposes of levy of 5% GST, irrespective of whether or not such brand is subsequently deregistered. A brand registered as on 15.05.2017 under the Copyright Act, 1957 shall also be treated as a registered brand for the purposes of levy of 5% GST. A brand registered as on 15.05.2017 under any law for the time being in force in any other country shall also be deemed to be a registered brand for the purposes of levy of 5% GST. 13 Misuse of brand name definition National Academy of Customs, Indirect Taxes and Narcotics (NACIN)
