This form is for information purposes only. 1. Use form LASC PRO 080 , Request to Continue Petition Hearing and Order, to request a continuance of a hearing on a Petition filed in the Probate Division . 2. A $20 f ee is required when submitting the request to continue form. 3. S eparate form s and fees are required for each Petition hearing t hat is sought to be continued. 4. The Request to Continue Petition form may only be used to request the continuance of a Petition hearing date . It shall not be used to request continuance of the following hearings: • Order to Show Cause (OSC) Hearing • Trial • Se ttlement Conference • Restraining Order Hearing • Motion 5. A Request to Continue Petition Hearing form must be submitted five (5) court days before the hearing you seek to continue. If the request is made less than 5 court days before the hearing on the Petitio n, an E x P arte A pplication is required to seek a continuance, or the party may appear at the scheduled hearing and request a continuance . 6. If the request i s made to continue the current hearing to meet a future hearing on a separate P etition in this case or a related case, insert this information including the case number next to a date listed at S ection 4 of the Request to Continue Petition Hearing and Order form. 7. If the request to continue is granted , the original hearing date will be taken off calendar and the new hearing date is the operative date. 8. If the request to continue is granted and the proposed continuance dates requested are not available on the court’s calendar, a date after the requested dates will be set by the c ourt. 9. If the request to co ntinue is denied , the original hearing date will remain on calendar . You should attend the hearin g at the date , time and location set . 10. A copy of the Order ruling on the request for continuance must be served on all parties that received notice of the filing of the Petition , and all parties that have appeared at any hearing on the Petition, filed documents related to the Petition you seek to continue , or filed a Request for Special Notice . 11. If the Petition is uncontested, only the signature of the party requesting a continuance is required on this form. If the Petition is contested * then the signatures of all respondents , competing petitioners, and persons who have appeared are required. If the signature of all those persons are not obtained, then an E x P arte A pplication or appearance at the hearing is required to request a continuance of the Petition hearing. * A Contested Petition is one wherein the case includes a filing of an objection, opposition, will contest, competing P etition, or other filin g requesting that the court deny or alter the relief requested in the initial P etition .
