The bill’s intent is to reduce the time for expungements for a specific subset of misdemeanor case types; qualifying misdemeanors carrying a penalt y of one year imprisonment or less. The bill reduces the time frame for a defendant to petition the court for expungement under 13V.S.A. §7602 from ten (10) years to five (5) years if all the other requirements have been completed. If this bill remains as introduced, the Judiciary should see no significant impact for the number of cases we would anticipate being added to the workload. We agree that the effective date of the act should remain as July 1,2017 to allow the Judiciary adequate time to update our legacy case management system to program our system to adequately track petitioned expungements for data collection purposes.
