Overview of Amendments Effective March 1, 2018 Offender Application for Transfer Victim’s Right to Comment New Documentation for Reporting Instructions Military Orders & Employment Transfers Returning Offenders Rejection of Transfer for offender in Receiving State w/ approved RIs

Offender’s Application for Transfer Provides an OPTION for a sending state to retain electronic copies removing the requirement to retain original signed forms Amendment to Rule 2.104 & 3.107 IMPACT ICOTS: None Rule/Opinion: None Compact Office: Your state’s document retention policies determine whether amendment is applicable to outgoing cases Field Users: As directed by Compact Office

Victim’s Right to Comment Expands the time frame a victim can provide comment regarding an interstate transfer request to 15 business days Amendment to Rule 3.108-1 IMPACT ICOTS: None-Victim comment does not delay time frames for responding to transfer requests Rule/Opinion: None Compact Office: Ensure your state’s policies complyField Users: None

New documentation Requirements for Military & Employment Transfer Reasons Amendment to Rule 3.101-1 IMPACT ICOTS: Documentation may be provided within the ‘conditions’ section OR use NEW ‘Reason’ attachment in RFRI Rule/Opinion: None Compact Office: Ensure documentation supports reason for transfer Field Users: Require offender to provide documentation when requesting transfer

Returning Offenders Receiving States Return Date Clarification-15 biz days after request received Confirm Arrival (or failure to arrive) PRIOR to validating closure Sending States Provide ‘Reason’ for Return Supervise until Departure! Offender absent from approved residence and employment? Follow absconder rule! Amendments to Rule 4.111

Workflow for ALL Returns Receiving State Request RI's Specify reason for return! NOD & CCN upon departure Supervisory Authority Ends Sending State Respond to RFRI (2 days)NOA confirm arrivalFailed to arrive? Issue WarrantCCN ResponseCASE CLOSED Be sure ‘date to return’ is within 15 biz days!!Amendments to Rule 4.111

Impact for ICOTS Users ICOTS: Use NEW ‘Reason’ attachment for RFRI Rule/Opinion: None Compact Office: Receiving State Review activities/profile before transmission! Sending StateReturn date must by within 15 biz daysEnsure NOA has been sent prior to validating closure-Review profile!Field Users (RS): Provide reason for return. Remember supervision does NOT stop at rejection! Amendments to Rule 4.111

Rejection of Transfer-Offender in Receiving State w/RI’s Receiving States Rejection indicates alternate plan exists in RS Submit new TREQ within 15 biz days Sending States Clear, concise rejections! (Return to SS vs Remain pending new TREQ) Compact office reviews rejections and determines when this rule is applied or when return RI’s are neededThe receiving state’s rejection initiates this process informing the sending state of an alternate plan to be submitted within 15 business days Amendment to Rules 3.104 & 4.111

Impact for ICOTS Users ICOTS: None. Requires communication via Transfer Rejection Rule/Opinion: None Compact Office: Receiving State Review rejection, activities, & profile! Determine when rule may be applied or when return RI’s are needed Follow up with field/Provide direction!Sending StateReview rejection, activities, & profile! When rule is applied by RS, ensure subsequent TREQ is submitted within 15 biz daysField Users: RS-Ensure rejection is clear whether offender is allowed to remain or if return RIs will be submitted Amendment to Rules 3.104 & 4.111
