CONSTITUTIONOFWHO1 BasicDocuments,Forty-fifthedition,Supplement,October2006Thistextreplacesthatonpages1-18oftheForty-fiftheditionofBasicdocuments,followingthecomingintoforceofamendmentsadoptedbytheFifty-firstWorldHealthAssembly.OFTHEWORLDHEALTHORGANIZATIONHESTATESPartiestothisConstitutiondeclare,inconformitywiththeCharteroftheUnitedNations,thatthefollowingprinciplesarebasictothehappiness,harmoniousrelationsandsecurityofallpeoples:Healthisastateofcompletephysical,mentalandsocialwell-beingandnotmerelytheabsenceofdiseaseorinfirmity.Theenjoymentofthehighestattainablestandardofhealthisoneofthefundamentalrightsofeveryhumanbeingwithoutdistinctionofrace,religion,politicalbelief,economicorsocialcondition.Thehealthofallpeoplesisfundamentaltotheattainmentofpeaceandsecurityandisdependentuponthefullestco-operationofindividualsandStates.TheachievementofanyStateinthepromotionandprotectionofhealthisofvaluetoall.Unequaldevelopmentindifferentcountriesinthepromotionofhealthandcontrolofdisease,especiallycommunicabledisease,isacommondanger.Healthydevelopmentofthechildisofbasicimportance;theabilitytoliveharmoniouslyinachangingtotalenvironmentisessentialtosuchdevelopment.Theextensiontoallpeoplesofthebenefitsofmedical,psychologicalandrelatedknowledgeisessentialtothefullestattainmentofhealth.Informedopinionandactiveco-operationonthepartofthepublicareoftheutmostimportanceintheimprovementofthehealthofthepeople.GovernmentshavearesponsibilityforthehealthoftheirpeopleswhichcanbefulfilledonlybytheprovisionofadequatehealthandsocialCCEPTINGTHESEPRINCIPLES,andforthepurposeofco-operationamongthemselvesandwithotherstopromoteandprotectthehealthofallpeoples,theContractingPartiesagreetothepresentConstitutionand The Constitution was adopted by the International Health Conference held in New York from 19 Juneto 22 July 1946, signed on 22 July 1946 by the representatives of 61 States (Off. Rec. Wld Hlth Org100), and entered into force on 7 April 1948. Amendments adopted by the Twenty-sixth, Twenty-ninth,Thirty-ninth and Fifty-first World Health Assemblies (resolutions WHA26.37, WHA29.38, WHA39.6 andWHA51.23) came into force on 3 February 1977, 20 January 1984, 11 July 1994 and 15 September 2005respectively and are incorporated in the present text. 1 ASICENTS,Supplement2006 herebyestablishtheWorldHealthOrganiationasaspecialiedagencywithinthetermsofArticleoftheCharteroftheUnitedNations.HAPTERECTIArticle1TheobjectiveoftheWorldHealthOrganihereinaftercalledtheOrganishallbetheattainmentbyallpeoplesofthehighestpossiblelevelofhealth.HAPTERUNCTIONSArticle2Inordertoachieveitsobjective,thefunctionsoftheOrganiationshalltoactasthedirectingandco-ordinatingauthorityoninternationalhealthwork;toestablishandmaintaineffectivecollaborationwiththeUnitedNations,specialiedagencies,governmentalhealthadministrations,professionalgroupsandsuchotherorganiationsasmaybedeemedtoassistGovernments,uponrequest,instrengtheninghealthservices;tofurnishappropriatetechnicalassistanceand,inemergencies,neces-saryaidupontherequestoracceptanceofGovernments;toprovideorassistinproviding,upontherequestoftheUnitedNations,healthservicesandfacilitiestospecialgroups,suchasthepeoplesoftrustterritories;toestablishandmaintainsuchadministrativeandtechnicalservicesasmayberequired,includingepidemiologicalandstatisticalservices;tostimulateandadvanceworktoeradicateepidemic,endemicandotherdiseases;topromote,inco-operationwithotherspecialiedagencieswherenec-essary,thepreventionofaccidentalinjuries;topromote,inco-operationwithotherspecialiedagencieswherenec-essary,theimprovementofnutrition,housing,sanitation,recreation,economicorworkingconditionsandotheraspectsofenvironmentalhygiene;topromoteco-operationamongscientificandprofessionalgroupswhichcontributetotheadvancementofhealth;toproposeconventions,agreementsandregulations,andmakerecom-mendationswithrespecttointernationalhealthmattersandtoperform CONSTITUTIONOFWHO suchdutiesasmaybeassignedtherebytotheOrganiationandareconsistentwithitsobjective;topromotematernalandchildhealthandwelfareandtofostertheabil-itytoliveharmoniouslyinachangingtotalenvironment;tofosteractivitiesinthefieldofmentalhealth,especiallythoseaffect-ingtheharmonyofhumanrelations;topromoteandconductresearchinthefieldofhealth;topromoteimprovedstandardsofteachingandtraininginthehealth,medicalandrelatedprofessions;tostudyandreporton,inco-operationwithotherspecialiedagencieswherenecessary,administrativeandsocialtechniquesaffectingpublichealthandmedicalcarefrompreventiveandcurativepointsofview,includinghospitalservicesandsocialsecurity;toprovideinformation,counselandassistanceinthefieldofhealth;toassistindevelopinganinformedpublicopinionamongallpeoplesonmattersofhealth;toestablishandreviseasnecessaryinternationalnomenclaturesofdis-eases,ofcausesofdeathandofpublichealthpractices;tostandardiediagnosticproceduresasnecessary;todevelop,establishandpromoteinternationalstandardswithrespecttofood,biological,pharmaceuticalandsimilarproducts;generallytotakeallnecessaryactiontoattaintheobjectiveoftheOrganiHAPTERIIIERSHIPANERSHIPArticle3embershipintheOrganiationshallbeopentoallStates.Article4embersoftheUnitedNationsmaybecomeembersoftheOrganitionbysigningorotherwiseacceptingthisConstitutioninaccordancewiththeprovisionsofChapterandinaccordancewiththeirconstitutionalArticle5TheStateswhoseGovernmentshavebeeninvitedtosendobserverstotheInternationalHealthConferenceheldinNework,16,maybecome ASICENTS,Supplement2006 embersbysigningorotherwiseacceptingthisConstitutioninaccordancewiththeprovisionsofChapterandinaccordancewiththeirconstitu-tionalprocessesprovidedthatsuchsignatureoracceptanceshallbecom-pletedbeforethefirstsessionoftheHealthAssembly.Article6SubjecttotheconditionsofanyagreementbetweentheUnitedNationsandtheOrganiation,approvedpursuanttoChapterI,StateswhichdonotbecomeembersinaccordancewithArticlesmayapplytoembersandshallbeadmittedasemberswhentheirapplicationhasbeenapprovedbyasimplemajorityvoteoftheHealthAssembly.Article7IfaemberfailstomeetitsfinancialobligationstotheOrganiationorinotherexceptionalcircumstances,theHealthAssemblymay,onsuchcon-ditionsasitthinksproper,suspendthevotingprivilegesandservicestowhichaemberisentitled.TheHealthAssemblyshallhavetheauthoritytorestoresuchvotingprivilegesandservices.Article8Territoriesorgroupsofterritorieswhicharenotresponsibleforthecon-ductoftheirinternationalrelationsmaybeadmittedasAssociatebytheHealthAssemblyuponapplicationmadeonbehalfofsuchterritoryorgroupofterritoriesbytheemberorotherauthorityhavingresponsibil-ityfortheirinternationalrelations.RepresentativesofAssociatetotheHealthAssemblyshouldbequalifiedbytheirtechnicalcompetenceinthefieldofhealthandshouldbechosenfromthenativepopulation.ThenatureandextentoftherightsandobligationsofAssociateembersshallbedeterminedbytheHealthAssembly.HAPTERRGANSArticle9TheworkoftheOrganiationshallbecarriedoutby:TheWorldHealthAssemblyhereincalledtheHealthAssemblyTheExecutivehereinaftercalledtheTheSecretariat. The amendment to this Article adopted by the Eighteenth World Health Assembly (resolutionWHA18.48) has not yet come into force. CONSTITUTIONOFWHO HAPTEREALTHArticle10TheHealthAssemblyshallbecomposedofdelegatesrepresentingembers.Article11embershallberepresentedbynotmorethanthreedelegates,oneofwhomshallbedesignatedbytheemberaschiefdelegate.Thesedele-gatesshouldbechosenfromamongpersonsmostqualifiedbytheirtechni-calcompetenceinthefieldofhealth,preferablyrepresentingthenationalhealthadministrationoftheember.Article12Alternatesandadvisersmayaccompanydelegates.Article13TheHealthAssemblyshallmeetinregularannualsessionandinsuchspecialsessionsasmaybenecessary.SpecialsessionsshallbeconvenedattherequestoftheoardorofamajorityoftheArticle14TheHealthAssembly,ateachannualsession,shallselectthecountryorregioninwhichthenextannualsessionshallbeheld,theoardsubse-quentlyfixingtheplace.Theoardshalldeterminetheplacewhereaspe-cialsessionshallbeheld.Article15oard,afterconsultationwiththeSecretary-GeneraloftheUnitedNations,shalldeterminethedateofeachannualandspecialsession.Article16TheHealthAssemblyshallelectitsPresidentandotherofficersatthebeginningofeachannualsession.Theyshallholdofficeuntiltheirsucces-sorsareelected.Article17TheHealthAssemblyshalladoptitsownrulesofprocedure. ASICENTS,Supplement2006 Article18ThefunctionsoftheHealthAssemblyshallbe:todeterminethepoliciesoftheOrganiation;tonametheembersentitledtodesignateapersontoserveontheoard;toappointtheirector-General;toreviewandapprovereportsandactivitiesoftheoardandoftheirector-Generalandtoinstructtheoardinregardtomattersuponwhichaction,study,investigationorreportmaybeconsidereddesira-ble;toestablishsuchcommitteesasmaybeconsiderednecessaryfortheworkoftheOrganiation;tosupervisethefinancialpoliciesoftheOrganiationandtoreviewandapprovethebudget;toinstructtheoardandtheirector-Generaltobringtotheattentionembersandofinternationalorganiations,governmentalornon-governmental,anymatterwithregardtohealthwhichtheHealthAssemblymayconsiderappropriate;toinviteanyorganiation,internationalornational,governmentalornon-governmental,whichhasresponsibilitiesrelatedtothoseoftheOrganiation,toappointrepresentativestoparticipate,withoutrightofvote,initsmeetingsorinthoseofthecommitteesandconferencescon-venedunderitsauthority,onconditionsprescribedbytheHealthAssembly;butinthecaseofnationalorganiations,invitationsshallbeissuedonlywiththeconsentoftheGovernmentconcerned;toconsiderrecommendationsbearingonhealthmadebytheGeneralAssembly,theEconomicandSocialCouncil,theSecurityCouncilorTrusteeshipCounciloftheUnitedNations,andtoreporttothemonthestepstakenbytheOrganiationtogiveeffecttosuchrecommenda-tions;toreporttotheEconomicandSocialCouncilinaccordancewithanyagreementbetweentheOrganiationandtheUnitedNations;topromoteandconductresearchinthefieldofhealthbythepersonneloftheOrganiation,bytheestablishmentofitsowninstitutionsorbyco-operationwithofficialornon-officialinstitutionsofanyemberwiththeconsentofitsGovernment;toestablishsuchotherinstitutionsasitmayconsiderdesirable;totakeanyotherappropriateactiontofurthertheobjectiveoftheOrganiation. CONSTITUTIONOFWHO Article19TheHealthAssemblyshallhaveauthoritytoadoptconventionsoragreementswithrespecttoanymatterwithinthecompetenceoftheOrgan-ation.Atwo-thirdsvoteoftheHealthAssemblyshallberequiredfortheadoptionofsuchconventionsoragreements,whichshallcomeintoforceforeachemberwhenacceptedbyitinaccordancewithitsconstitutionalArticle20emberundertakesthatitwill,withineighteenmonthsaftertheadoptionbytheHealthAssemblyofaconventionoragreement,takeactionrelativetotheacceptanceofsuchconventionoragreement.Eachembershallnotifytheirector-Generaloftheactiontaken,andifitdoesnotacceptsuchconventionoragreementwithinthetimelimit,itwillfurnishastatementofthereasonsfornon-acceptance.Incaseofacceptance,eachemberagreestomakeanannualreporttotheirector-Generalinaccord-ancewithChapterArticle21TheHealthAssemblyshallhaveauthoritytoadoptregulationsconcern-ing:sanitaryandquarantinerequirementsandotherproceduresdesignedtopreventtheinternationalspreadofdisease;nomenclatureswithrespecttodiseases,causesofdeathandpublichealthpractices;standardswithrespecttodiagnosticproceduresforinternationaluse;standardswithrespecttothesafety,purityandpotencyofbiological,pharmaceuticalandsimilarproductsmovingininternationalcom-advertisingandlabellingofbiological,pharmaceuticalandsimilarproductsmovingininternationalcommerce.Article22RegulationsadoptedpursuanttoArticle21shallcomeintoforceforallembersafterduenoticehasbeengivenoftheiradoptionbytheHealthAssemblyexceptforsuchembersasmaynotifytheirector-Generalofrejectionorreservationswithintheperiodstatedinthenotice. ASICENTS,Supplement2006 Article23TheHealthAssemblyshallhaveauthoritytomakerecommendationstoemberswithrespecttoanymatterwithinthecompetenceoftheOrgani-ation.HAPTERECUTIOARArticle24Theoardshallconsistofthirty-fourpersonsdesignatedbyasmanyembers.TheHealthAssembly,takingintoaccountanequitablegeo-graphicaldistribution,shallelecttheembersentitledtodesignateaper-sontoserveontheoard,providedthat,ofsuchembers,notlessthanthreeshallbeelectedfromeachoftheregionalorganiationsestablishedpursuanttoArticle.Eachoftheseembersshouldappointtotheapersontechnicallyqualifiedinthefieldofhealth,whomaybeaccompa-niedbyalternatesandadvisers.Article25Theseembersshallbeelectedforthreeyearsandmaybere-elected,providedthatoftheemberselectedatthefirstsessionoftheHealthAssemblyheldafterthecomingintoforceoftheamendmenttothisConsti-tutionincreasingthemembershipoftheoardfromthirty-twotothirty-fourthetermofofficeoftheadditionalemberselectedshall,insofarasmaybenecessary,beofsuchlesserdurationasshallfacilitatetheelectionofatleastoneemberfromeachregionalorganiationineachyear.Article26Theoardshallmeetatleasttwiceayearandshalldeterminetheplaceofeachmeeting.Article27TheoardshallelectitsChairmanfromamongitsmembersandshalladoptitsownrulesofprocedure.Article28Thefunctionsoftheoardshallbe:togiveeffecttothedecisionsandpoliciesoftheHealthAssembly;toactastheexecutiveorganoftheHealthAssembly; CONSTITUTIONOFWHO toperformanyotherfunctionsentrustedtoitbytheHealthAssembly;toadvisetheHealthAssemblyonquestionsreferredtoitbythatbodyandonmattersassignedtotheOrganiationbyconventions,agree-mentsandregulations;tosubmitadviceorproposalstotheHealthAssemblyonitsowninitia-tive;topreparetheagendaofmeetingsoftheHealthAssembly;tosubmittotheHealthAssemblyforconsiderationandapprovalagen-eralprogrammeofworkcoveringaspecificperiod;tostudyallquestionswithinitscompetence;totakeemergencymeasureswithinthefunctionsandfinancialresourcesoftheOrganiationtodealwitheventsrequiringimmediateaction.Inparticularitmayauthorietheirector-Generaltotakethenecessarystepstocombatepidemics,toparticipateintheorganiationofhealthrelieftovictimsofacalamityandtoundertakestudiesandresearchtheurgencyofwhichhasbeendrawntotheattentionoftheoardbyanyemberorbytheirector-General.Article29oardshallexerciseonbehalfofthewholeHealthAssemblythepowersdelegatedtoitbythatbody.HAPTERECRETARIATArticle30TheSecretariatshallcomprisetheirector-GeneralandsuchtechnicalandadministrativestaffastheOrganiationmayrequire.Article31irector-GeneralshallbeappointedbytheHealthAssemblyonthenominationoftheoardonsuchtermsastheHealthAssemblymaydeter-mine.Theirector-General,subjecttotheauthorityoftheoard,shallbethechieftechnicalandadministrativeofficeroftheOrganiation.Article32irector-Generalshallbeex-officioSecretaryoftheHealthAssem-bly,oftheoard,ofallcommissionsandcommitteesoftheOrganiationandofconferencesconvenedbyit.Hemaydelegatethesefunctions. ASICENTS,Supplement2006 Article33Theirector-Generalorhisrepresentativemayestablishaprocedurebyagreementwithembers,permittinghim,forthepurposeofdischarginghisduties,tohavedirectaccesstotheirvariousdepartments,especiallytotheirhealthadministrationsandtonationalhealthorganiations,govern-mentalornon-governmental.HemayalsoestablishdirectrelationswithinternationalorganiationswhoseactivitiescomewithinthecompetenceoftheOrganiation.Heshallkeepregionalofficesinformedonallmattersinvolvingtheirrespectiveareas.Article34Theirector-GeneralshallprepareandsubmittotheoardthefinancialstatementsandbudgetestimatesoftheOrganiation.Article35Theirector-GeneralshallappointthestaffoftheSecretariatinaccord-ancewithstaffregulationsestablishedbytheHealthAssembly.Thepara-mountconsiderationintheemploymentofthestaffshallbetoassurethattheefficiency,integrityandinternationallyrepresentativecharacteroftheSecretariatshallbemaintainedatthehighestlevel.ueregardshallbepaidalsototheimportanceofrecruitingthestaffonaswideageographicalbasisaspossible.Article36TheconditionsofserviceofthestaffoftheOrganiationshallconformasfaraspossiblewiththoseofotherUnitedNationsorganiations.Article37Intheperformanceoftheirdutiestheirector-GeneralandthestaffshallnotseekorreceiveinstructionsfromanygovernmentorfromanyauthorityexternaltotheOrganiation.Theyshallrefrainfromanyactionwhichmightreflectontheirpositionasinternationalofficers.EachberoftheOrganiationonitspartundertakestorespecttheexclusivelyinternationalcharacteroftheirector-Generalandthestaffandnottoseektoinfluencethem.HAPTERIIIITTEESArticle38TheoardshallestablishsuchcommitteesastheHealthAssemblymaydirectand,onitsowninitiativeorontheproposaloftheirector-General,mayestablishanyothercommitteesconsidereddesirabletoserveanypur-posewithinthecompetenceoftheOrganiation. CONSTITUTIONOFWHO11 Article39oard,fromtimetotimeandinanyeventannually,shallreviewthenecessityforcontinuingeachcommittee.Article40oardmayprovideforthecreationofortheparticipationbytheOrganiationinjointormixedcommitteeswithotherorganiationsandfortherepresentationoftheOrganiationincommitteesestablishedbysuchotherorganiations.HAPTERONFERENCESArticle41TheHealthAssemblyortheoardmayconvenelocal,general,techni-calorotherspecialconferencestoconsideranymatterwithinthecompe-tenceoftheOrganiationandmayprovidefortherepresentationatsuchconferencesofinternationalorganiationsand,withtheconsentoftheGovernmentconcerned,ofnationalorganiations,governmentalornon-governmental.ThemannerofsuchrepresentationshallbedeterminedbytheHealthAssemblyortheoard.Article42oardmayprovideforrepresentationoftheOrganiationatconfer-encesinwhichtheoardconsidersthattheOrganiationhasaninterest.HAPTERUARTERSArticle43ThelocationoftheheadquartersoftheOrganiationshallbedeterminedbytheHealthAssemblyafterconsultationwiththeUnitedNations.HAPTEREGIONALRRANGEENTSArticle44TheHealthAssemblyshallfromtimetotimedefinethegeographi-calareasinwhichitisdesirabletoestablisharegionalorganiation.TheHealthAssemblymay,withtheconsentofamajorityoftheemberssituatedwithineachareasodefined,establisharegionalorgani-ationtomeetthespecialneedsofsucharea.Thereshallnotbemorethanoneregionalorganiationineacharea. ASICENTS,Supplement2006 Article45EachregionalorganiationshallbeanintegralpartoftheOrganiationinaccordancewiththisConstitution.Article46Eachregionalorganiationshallconsistofaregionalcommitteeandaregionaloffice.Article47RegionalcommitteesshallbecomposedofrepresentativesoftheberStatesandAssociateembersintheregionconcerned.Territoriesorgroupsofterritorieswithintheregion,whicharenotresponsiblefortheconductoftheirinternationalrelationsandwhicharenotAssociatebers,shallhavetherighttoberepresentedandtoparticipateinregionalcommittees.Thenatureandextentoftherightsandobligationsoftheseter-ritoriesorgroupsofterritoriesinregionalcommitteesshallbedeterminedbytheHealthAssemblyinconsultationwiththeemberorotherauthorityhavingresponsibilityfortheinternationalrelationsoftheseterritoriesandwiththeemberStatesintheregion.Article48Regionalcommitteesshallmeetasoftenasnecessaryandshalldeter-minetheplaceofeachmeeting.Article49Regionalcommitteesshalladopttheirownrulesofprocedure.Article50Thefunctionsoftheregionalcommitteeshallbe:toformulatepoliciesgoverningmattersofanexclusivelyregionalchar-tosupervisetheactivitiesoftheregionaloffice;tosuggesttotheregionalofficethecallingoftechnicalconferencesandsuchadditionalworkorinvestigationinhealthmattersasintheopinionoftheregionalcommitteewouldpromotetheobjectiveoftheOrganitionwithintheregion;toco-operatewiththerespectiveregionalcommitteesoftheUnitedNationsandwiththoseofotherspecialiedagenciesandwithotherregionalinternationalorganiationshavinginterestsincommonwiththeOrgani CONSTITUTIONOFWHO1 totenderadvice,throughtheirector-General,totheOrganiationoninternationalhealthmatterswhichhavewiderthanregionalsignifi-torecommendadditionalregionalappropriationsbytheGovernmentsoftherespectiveregionsiftheproportionofthecentralbudgetoftheOrganiationallottedtothatregionisinsufficientforthecarrying-outoftheregionalfunctions;suchotherfunctionsasmaybedelegatedtotheregionalcommitteebytheHealthAssembly,theoardortheirector-General.Article51Subjecttothegeneralauthorityoftheirector-GeneraloftheOrganition,theregionalofficeshallbetheadministrativeorganoftheregionalcommittee.Itshall,inaddition,carryoutwithintheregionthedecisionsoftheHealthAssemblyandoftheoard.Article52TheheadoftheregionalofficeshallbetheRegionalirectorappointedbytheoardinagreementwiththeregionalcommittee.Article53Thestaffoftheregionalofficeshallbeappointedinamannertobedeterminedbyagreementbetweentheirector-GeneralandtheRegionalirector.Article54ThePanAmericanSanitaryOrgani represented by the PanAmerican Sanitary Bureau and the Pan American Sanitary Conferences,and all other inter-governmental regional health organizations in existenceprior to the date of signature of this Constitution, shall in due course beintegrated with the Organization. This integration shall be effected as soonas practicable through common action based on mutual consent of thecompetent authorities expressed through the organizations concerned.HAPTERGETANPENSESArticle55irector-GeneralshallprepareandsubmittotheoardthebudgetestimatesoftheOrganiation.TheoardshallconsiderandsubmittotheHealthAssemblysuchbudgetestimates,togetherwithanyrecommenda-tionstheoardmaydeemadvisable. ASICENTS,Supplement2006 Article56SubjecttoanyagreementbetweentheOrganiationandtheUnitedNations,theHealthAssemblyshallreviewandapprovethebudgetesti-matesandshallapportiontheexpensesamongtheembersinaccordancewithascaletobefixedbytheHealthAssembly.Article57TheHealthAssemblyortheoardactingonbehalfoftheHealthAssemblymayacceptandadministergiftsandbequestsmadetotheOrgan-ationprovidedthattheconditionsattachedtosuchgiftsorbequestsareacceptabletotheHealthAssemblyortheoardandareconsistentwiththeobjectiveandpoliciesoftheOrganiation.Article58Aspecialfundtobeusedatthediscretionoftheoardshallbeestab-lishedtomeetemergenciesandunforeseencontingencies.HAPTERIIIOTINGArticle59embershallhaveonevoteintheHealthAssembly.Article60ecisionsoftheHealthAssemblyonimportantquestionsshallbemadebyatwo-thirdsmajorityoftheemberspresentandvoting.Thesequestionsshallinclude:theadoptionofconventionsoragreements;theapprovalofagreementsbringingtheOrganiationintorelationwiththeUnitedNationsandinter-governmentalorganiationsandagenciesinaccordancewithArticles60and2;amendmentstothisConstitution.ecisionsonotherquestions,includingthedeterminationofaddi-tionalcategoriesofquestionstobedecidedbyatwo-thirdsmajority,shallbemadebyamajorityoftheemberspresentandvoting.otingonanalogousmattersintheoardandincommitteesoftheOrganiationshallbemadeinaccordancewithparagraphsandthisArticle.HAPTEREPORTSSUITTEDBYTATESArticle61embershallreportannuallytotheOrganiationontheactiontakenandprogressachievedinimprovingthehealthofitspeople. CONSTITUTIONOFWHO1 Article62embershallreportannuallyontheactiontakenwithrespecttorecommendationsmadetoitbytheOrganiationandwithrespecttocon-ventions,agreementsandregulations.Article63embershallcommunicatepromptlytotheOrganiationimpor-tantlaws,regulations,officialreportsandstatisticspertainingtohealthwhichhavebeenpublishedintheStateconcerned.Article64embershallprovidestatisticalandepidemiologicalreportsinamannertobedeterminedbytheHealthAssembly.Article65embershalltransmitupontherequestoftheoardsuchaddi-tionalinformationpertainingtohealthasmaybepracticable.HAPTERXVEGALAPACITILEGESANUNITIESArticle66TheOrganiationshallenjoyintheterritoryofeachembersuchlegalcapacityasmaybenecessaryforthefulfilmentofitsobjectiveandfortheexerciseofitsfunctions.Article67TheOrganiationshallenjoyintheterritoryofeachembersuchprivilegesandimmunitiesasmaybenecessaryforthefulfilmentofitsobjectiveandfortheexerciseofitsfunctions.Representativesofembers,personsdesignatedtoserveontheoardandtechnicalandadministrativepersonneloftheOrganiationshallsimilarlyenjoysuchprivilegesandimmunitiesasarenecessaryfortheindependentexerciseoftheirfunctionsinconnexionwiththeOrganiation.Article68Suchlegalcapacity,privilegesandimmunitiesshallbedefinedinasepa-rateagreementtobepreparedbytheOrganiationinconsultationwiththeSecretary-GeneraloftheUnitedNationsandconcludedbetweenthe ASICENTS,Supplement2006 HAPTERELATIONSWITHTHERRGANIATIONSArticle69TheOrganiationshallbebroughtintorelationwiththeUnitedNationsasoneofthespecialiedagenciesreferredtoinArticleoftheCharteroftheUnitedNations.TheagreementoragreementsbringingtheOrganitionintorelationwiththeUnitedNationsshallbesubjecttoapprovalbyatwo-thirdsvoteoftheHealthAssembly.Article70TheOrganiationshallestablisheffectiverelationsandco-operatecloselywithsuchotherinter-governmentalorganiationsasmaybedesira-ble.Anyformalagreemententeredintowithsuchorganiationsshallbesubjecttoapprovalbyatwo-thirdsvoteoftheHealthAssembly.Article71TheOrganiationmay,onmatterswithinitscompetence,makesuitablearrangementsforconsultationandco-operationwithnon-governmentalinternationalorganiationsand,withtheconsentoftheGovernmentcon-cerned,withnationalorganiations,governmentalornon-governmental.Article72Subjecttotheapprovalbyatwo-thirdsvoteoftheHealthAssembly,theOrganiationmaytakeoverfromanyotherinternationalorganiationoragencywhosepurposeandactivitiesliewithinthefieldofcompetenceoftheOrganiationsuchfunctions,resourcesandobligationsasmaybecon-ferredupontheOrganiationbyinternationalagreementorbymutuallyacceptablearrangementsenteredintobetweenthecompetentauthoritiesoftherespectiveorganiations.HAPTERENTSArticle73TextsofproposedamendmentstothisConstitutionshallbecommuni-catedbytheirector-GeneraltoembersatleastsixmonthsinadvanceoftheirconsiderationbytheHealthAssembly.Amendmentsshallcomeintoforceforallemberswhenadoptedbyatwo-thirdsvoteoftheHealthAssemblyandacceptedbytwo-thirdsoftheembersinaccordancewiththeirrespectiveconstitutionalprocesses. CONSTITUTIONOFWHO1 HAPTERIIINTERPRETATIONArticle74TheChinese,English,French,RussianandSpanishtextsofthisConsti-tutionshallberegardedasequallyauthentic.Article75AnyquestionordisputeconcerningtheinterpretationorapplicationofthisConstitutionwhichisnotsettledbynegotiationorbytheHealthAssemblyshallbereferredtotheInternationalCourtofusticeinconform-itywiththeStatuteoftheCourt,unlessthepartiesconcernedagreeonanothermodeofsettlement.Article76UponauthoriationbytheGeneralAssemblyoftheUnitedNationsoruponauthoriationinaccordancewithanyagreementbetweentheOrgani-ationandtheUnitedNations,theOrganiationmayrequesttheInterna-tionalCourtofusticeforanadvisoryopiniononanylegalquestionarisingwithinthecompetenceoftheOrganiation.Article77irector-GeneralmayappearbeforetheCourtonbehalfoftheOrganiationinconnexionwithanyproceedingsarisingoutofanysuchrequestforanadvisoryopinion.Heshallmakearrangementsforthepres-entationofthecasebeforetheCourt,includingarrangementsfortheargu-mentofdifferentviewsonthequestion.HAPTERNTRINTOArticle78SubjecttotheprovisionsofChapterIII,thisConstitutionshallremainopentoallStatesforsignatureoracceptance.Article79StatesmaybecomepartiestothisConstitutionby:signaturewithoutreservationastoapproval;signaturesubjecttoapprovalfollowedbyacceptance;oriiiacceptance. The amendment to this Article adopted by the Thirty-first World Health Assembly (resolutionWHA31.18) has not yet come into force. ASICENTS,Supplement2006 AcceptanceshallbeeffectedbythedepositofaformalinstrumentwiththeSecretary-GeneraloftheUnitedNations.Article80ThisConstitutionshallcomeintoforcewhentwenty-sixembersoftheUnitedNationshavebecomepartiestoitinaccordancewiththeprovisionsofArticleArticle81InaccordancewithArticle102oftheCharteroftheUnitedNations,theSecretary-GeneraloftheUnitedNationswillregisterthisConstitutionwhenithasbeensignedwithoutreservationastoapprovalonbehalfofoneStateorupondepositofthefirstinstrumentofacceptance.Article82TheSecretary-GeneraloftheUnitedNationswillinformStatespartiestothisConstitutionofthedatewhenithascomeintoforce.HewillalsoinformthemofthedateswhenotherStateshavebecomepartiestothisConstitution.NFAITHWHEREOFtheundersignedrepresentatives,havingbeendulyedforthatpurpose,signthisConstitution.ONEintheCityofNeworkthistwenty-seconddayofuly16,inasinglecopyintheChinese,English,French,RussianandSpanishlan-guages,eachtextbeingequallyauthentic.Theoriginaltextsshallbedepos-itedinthearchivesoftheUnitedNations.TheSecretary-GeneraloftheUnitedNationswillsendcertifiedcopiestoeachoftheGovernmentsrepre-sentedattheConference.__________ ASICENTS,Supplement2006
