Drunkenness is a condition produced in an person who has taken alcohol in a sufficient quantity so as to lose the control of his faculties in such a way that it renders him unable to execute safely the occupation in which he was engaged at that particular time.

An individual can be certified to be drunk only when there is evidence that “he was so much under the influence of alcohol as to have lost control of his faculties to such an extent as to render him unable to execute safely the occupation in which he was engaged at the material time”Slide3

Medical terminology

Below 10 mg% : Sober

20 to 70mg%

: Drinking

80 to 100 mg% : Under the influence

150 to 300mg%: Drunk of Intoxicated.

400mg% and above : Come and Death.

Legal Limit of alcohol in blood in India is : 30mg% ( Section 185, Motor Vehicle Act)Slide4

Importance

Consumption of alcohol in any form is an offence in an area where the prohibition act is in force. To be found drunk and incapable of taking care of oneself or to behave in a disorderly manner in a public place is a greater offence.

In case of assault, rape or homicide, the victim or the assailant might have been drinking and fact will materially influence the case before a court.Slide5

Importance

A person who has intoxicated himself is responsible for his acts, but not at all if another person forces it on him.

An intoxicated person cannot give valid consent.Slide6

Conditions to be ruled out

Severe head injuries

Metabolic disorders:-Hypoglycemia due to insulin, hyperthyroidism, uremia.

CNS disorders like:- disseminated sclerosis, intracranial tumors, epilepsy and parkinson’s disease.

Drug reactions :- insulin, antihistamines, barbiturates, morphine etc

Certain pre existing psychological disorders e.g., hypomania, general paresis.

High fever.

Carbon monoxide poisoning

The Section reads as: Whoever, while driving, or attempting

to

drive a motor vehicle (

a) has in his blood alcohol

exceeding

mg per 100 ml of blood detected in a test by a

breath

analyser

b) is under the influence of a drug to such

as to be incapable of exercising proper control over

the vehicle

shall be punishable for the first offence with

imprisonment for

a term that may extend to 6 months or with fine
