Legality - Fake Weapons

There are two Acts of Parliament that regulate firearms and the public display of firearms or

fake weapons

in Victoria. They are

:

the Control of Weapons Act 1990the

Firearms Act 1996

.

Anything that can be mistaken for a firearm based on its overall appearance requires

police approval

if it is carried in public. The decision as to whether it resembles a real weapon is a

matter for

legal opinion. It is decided ‘on balance’ based on what a reasonable person would think

.

Toy firearms must have the following characteristics to avoid being reasonably mistaken for a

real firearm.

The

colouring should not be the same as that of a working weapon.

Materials

should be immediately recognisable as not being associated with real weapons.

The shape and size should indicate that they are

toysSlide6

Safety – Risk Management

Assess the level of risk.

Decide on control measures.
