Plaintiff suffered a traumatic brain injury when the back panel of a “Free Motion” cable cross-over machine came loose and struck her head at a 24 Hour Fitness facility. When plaintiff joined the 24 Hour Fitness facility, she signed a Membership Agreement that included a release of liability. Under the release provision, plaintiff agreed that 24 Hour Fitness would not be liable for any injury she suffered as a result of 24 Hour’s negligence. Plaintiff and her husband sued 24 Hour Fitness for ordinary and gross negligence, premises liability and strict products liability. 24 Hour Fitness moved for summary judgment, arguing that the release in the Membership Agreement barred plaintiffs’ claims for negligence and premises liability.
