PPC PRESENTATION ON LATEST DEVELOPMENTS AT LILY MINE
Lily mine is a gold mine located in Barberton in Mpumalanga Province.
The mine was owned by Makonjwaan Imperial Mining Company (Pty) Ltd (MIMCO).
MIMCO was granted a mining licence in May 2003.
The mine’s main open pit began production in September 2006.
The mine converted the open pit into underground mining operations in July 2007.
The mining licence was converted into the mining right in November 2012. 3 Introduction<br>

On the 5th of February 2016 a portion of the crown pillar collapsed and caved into old underground workings.
At the time of the accident, there were 76 mine employees underground.
After the collapse, it was discovered that 3 mine employees were inside the lamp room.
Rescue operation commenced and 76 mine employees were rescued.
Unsafe underground conditions caused the rescue operation to be suspended.
The 3 employees are still trapped underground.

Production ceased after the accident in 2016 and the mine was placed under business rescue. 5 Schematic Representation of Accident<br>

An investigation was initiated in terms of the Mine Health and Safety Act (No. 29 of 1996 as amended) and converted into an inquiry during February 2017.
The inquiry in terms of section 65(1) of MHS Act commenced on 6 March 2017.
All the respective stakeholders including the employer and organised labour was issued with a copy of the inquiry report.
The employer was instructed ensure that the respective recommendations of the report are implemented at the mine.
A copy of the report, recommendations for criminal prosecution, was submitted to the Director of Public Prosecutions.
The Department also presented the outcome of the inquiry to the families of the missing employees. 6 Accident Investigation and Inquiry<br>

The National Director of Public Prosecutions should as a matter of urgency initiate proceedings in a Court of Law to declare the missing employees as presumed deceased.
Once the three missing employees have been confirmed deceased, the National Director of Public Prosecutions was recommended to prosecute various employer representatives on charges of:
Culpable homicide.
Contravening sections 2 (1) (a) (i), 11 (1), 11 (2), 11 (3) and section 5 (1) read with regulation 14.5 of the Mine Health and Safety Act No.29 of 1996.
Contravening section 25 (1) (c) of the Mineral and Petroleum Resources Development Act No.28 of 2002.
The Principal Inspector of Mines to impose an administrative fine to the employer for contravening regulations 23.4 (b), 23.4 (a) (vi), 23.4 (a) (v), 17.7 (c) and regulation 14.1 (8) of the Mine Health and Safety Act No.29 of 1996. 7 Inquiry Report Recommendations<br>

8 Lily Mine Progress Report The Department had numerous meetings with the prospective buyers, Business Rescue Practioner (BRP) and organised labour to ensure that the mine is re-opened.
At least 600 jobs will be saved once the Lily and Barbrook mines re-opens.
Mine to develop a new decline of about and new ventilation shaft.
Recovery of three missing employees concurrently with mining operation.<br>

9 Conclusion The Department will work closely with the BRP to ensure that the mines are re-opened as soon as funders are secured.
The Department will continue to engage the Director: Public Prosecutions regarding progress with the prosecution.
The BRP has indicated that security is provided to prevent illegal operations at the mines.
Communities and ex-employees are urged not to go underground as a result of safety concerns.<br>
