Right to education is a fundamental right guaranteed under the constitution. The Constitution (Eighty-sixth Amendment) Act, 2002 inserted Article 21-A in the Constitution of India. The Article 21-A states - The state shall provide free and compulsory education of all children in the age group of six to fourteen years in such a manner as the State may, by law, determine. Article 45 of the constitution also provides that the state must endeavor to provide education for all the children. But as this article is a directive principle it cant be enforced against the state. A LAW FOR EDUCATION The Right of Children to Free and Compulsory Education Act or Right to Education Act (RTE) is an Act of the Parliament of India enacted on 4 August 2009. describes the importance of free and compulsory education for children between the age of 6 to 14 years This act came into effect from 1 April, 2010 India among 135 countries to make education a fundamental right FREE AND COMPULSORY EDUCATION A CHILD’S RIGHT TO EDUCATION Every child in age group 6 to 14 years has the right to get free and compulsory education until their elementary education – sec 3 of The Right of Children to Free and Compulsory Education Act or Right to Education Act (RTE). Children with disabilities are also covered under this act. Where a child above six years of age has not been admitted in any school or though admitted, could not complete his or her elementary education, then, he or she shall be admitted in a class appropriate to his or her age Continuation When a child is directly admitted in a class appropriate to his or her age, then, he or she shall, have a right to receive special training A child so admitted to elementary education shall be entitled to free education till completion of elementary education even after
