The Legal and Governance aspects of “Nature- based Solutions” or “NbS” Importance of the Oceans: “NbS” must be integrated into COP26 considerations here in Glasgow; If we continue on our current trajectory, not only will we hasten climate impacts, but induce environmental and social catastrophes – especially in nations dependent on ocean harvest; At global level existing regulatory instruments do exists, but suffer from traditional issues characterizing environmental law treaties, namely lack of effectiveness in the management, implementation, compliances and coordination; Need to incorporate NbS into hard/soft law, such as, for example: Sustainable Development Goal (SDG) n. 13 (climate action) could be the link for several other SDGs including cities, communities, life below water and life on the land; At EU Level: the European Green Deal (EU GD) focus on climate action and biodiversity conservation – but EU GD Agenda needs greater impact. Sandra Cassotta, Associate Professor in International, Environmental and Energy Law, Department of Law, Aalborg University (Denmark) – COP 26, Glasgow, 2021 The Legal and Governance aspects of “Nature- based Solutions” or “NbS” To sum up, what is needed is to: Integrate and coordinate the global environmental legal instruments; To enable National Determined Contributions (NDSs)’s architecture in the Paris agreement to integrate the NbS, and complement the NDCs with the “Local Determined Contributions” (LDCs) in order to motivate both national and local action and engage citizens; To make NbS gain universal acceptance by including Indigenous People and marginalized communities; Include technical and financial support, as there is a lack of funding especially for the Least Developing Countries (LDCs).
