10.  Living WillsHow to set up your Living WillsWhilst you are welcome to seek professional legal advice, you do NOT need it to draw one up.Can be done for free. The Compassion in Dying website (www.compassionindying.org.uk) provides both a downloadable template to complete by hand and an online template to fill in directly on your computer. The Alzheimer’s website has a free template too.Some people draw them up with their Doctor during an appointment.A copy should be given to your GP and any other medical professionals you converse with

11.  Health & Welfare Lasting Power of Attorney (LPA)What is it?A Legal document which allows you to appoint relatives and trusted loved ones as “Attorney’s” who can act on your behalf and make decisions if you have been diagnosed as mentally incapacitated.

12.  Health & Welfare Lasting Power of Attorney (LPA)What can you do with a Health & Welfare LPA?You can list exact scenarios where Attorneys are to act in certain ways.You can also list guidance for the general considerations your attorneys should give when making decisions for you.Whereas Living Wills must cover specific scenarios and then actions that must follow, LPAs also give Attorneys power to make decisions “on the spot”. These means they can react in fluid situations and can take control during events that were unforeseen at the time of making the LPA

14.  Health & Welfare Lasting Power of Attorney (LPA)AttorneysMust act in your best interest and if you make any conditions, they must follow them.You can appoint as many Attorneys as you wish.You can appoint them in two groups, “Main Attorneys” or “Reserve Attorneys”. The latter would wait in the background and only get promoted if the Main Attorneys can no longer act. If you rather, you can appoint everyone as Main Attorneys.Where you are appointing multiple Attorneys, you must decide whether they must act “jointly” or can act independently as “jointly and severally”.

15.  Health & Welfare Lasting Power of Attorney (LPA)How do you set an LPA up?Do it yourself? Forms can be downloaded from the Office of the Public Guardian website. You save on professional fees but still have to pay the court’s registration fee. Mistakes are commonplace and when that happens the court will reject it and you’ll need to repay the registration fee again. Even those who get through the registration without issue, might still have future problems.Legal Professional A more costly option but all responsibility lies with them and by using a professional you can feel reassured it has been done correctly.Registration process and duration Currently the Office of the Public Guardian are taking around 20 weeks to register LPAs and there is no way to expedite your case. Therefore never wait until you need it before setting up your LPA and registering it, the best time is always NOW!
