Textingwhiledrivinghasrecentlyemergedasamajorpublicsafetyissue.There’sbeenacon-siderable amount of commentary about the dangers of distracted driving, especially when thedistraction is caused by texting. The Occupational Safety and Health Administration (OSHA)has officially declared texting while driving a workplace hazard and an OSHA violation, andthe National Traffic Safety Board recently recommended a total ban on the use of cell phonesand similar devices by drivers.. In an open letter to employers, OSHA explained that it is the employer’s “responsibility andlegal obligation to create and maintain a safe and healthful workplace, and that would includehaving a clear, unequivocal and enforced policy against the hazard of texting while driving.

Companies

are

in

violation

of

[OSHA

regulations]

if,

by

policy

or

practice,

they

require

texting

while

driving,

or

create

incentives

that

encourage

or

condone

it,

or

they

structure

work

so

that

texting

is

a

practical

necessity

for

workers

to

carry

out

their

job.”

OSHA

warns

employers

that

it

will

investigate

complaints

and

impose

penalties

on

companies

that

fail

to

comply

with

its

guidelines.

The

U.S.

Department

of

Labor

and

the

U.S.

Department

of

Transportation

have

partnered

with

OSHA

in

its

distracted-driving

initiative,

making

it

clear

that

lawmakers

and

government

agencies

are

focused

on

ending

distracted

driving.

OSHA’s

edict

follows

many

states

that

have

already

enacted

bans

on

texting

while

driving.

Every time a commercial truck or bus driver takes his or her eyes off the road to use a cell phone, even for a few seconds, the driver places everyone around them at risk," said U.S. Transportation Secretary Ray LaHoodSlide12

The Federal Motor Carrier Safety Administration (FMCSA) rule would;

prohibit commercial drivers

from reaching for, holding or dialing a cell phone while operating a CMVSlide13

$2,750

for each offense
