(ESSA)

School Year 2016-2017 is considered a transitional year from NCLB to

ESSA.Slide8

During the transition year, States

will be absolved from certain NCLB requirements, while more time will be allowed to develop new policies required under the new ESSA.Slide9

with the following provisions which are

not continued under ESSA:

1) Section

1111(h)(1)(C)(ii) and (h)(2) of the ESEA, as amended by NCLB, which require each State and LEA to

report performance against

AMOs.

) Section 1111(h)(6)(B)(ii) of the ESEA, as amended by NCLB, which requires a school to

notify parents

when their child has been assigned to, or has been taught for four or more consecutive weeks by, a teacher who is not

highly

qualified. Slide10

States and LEAs

do not

need to comply during the 2016-2017

school year

with the following provisions which are

not continued under ESSA:

3) Section

1119 of the ESEA, as amended by NCLB, which requires that each LEA

hire highly qualified teachers

; that each State and LEA

report on progress toward all teachers being highly

qualified.

) Section 2141 of the ESEA, as amended by NCLB, which requires an

LEA not making progress toward all teachers being highly qualified to create and implement an improvement plan

and requires the State to provide technical assistance to such

provide notice to parents

All teachers and paraprofessionals working in a program supported with

federal funds must meet

applicable State certification and licensure requirements, including any requirements for certification obtained through alternative routes to certification

LEAs

are required to continue

to comply with

section 1111(h)(6)(A) of the ESEA, as amended by NCLB, which requires an LEA to

notify parents

that they may request and the LEA will provide certain information regarding the

professional qualifications

of the student’s

teachers and paraprofessionals

, as appropriate.

LEAs have to provide timely parent notification that

the student has been assigned, or has been taught for 4 or more consecutive weeks by, a teacher who does not meet applicable

State certification or licensure requirements at the grade level and subject area

in which the teacher has been

requirements in section 3302(a) of the ESEA, as amended by NCLB through the 2016-2017 school year, which requires that an LEA provide notice to the parent or parents of a student identified as an

within 30 days of the start of the school year (or for students

identified later in the school year, within two weeks) that includes, for example, the reason for identification, parents’ rights, and other important information. Slide18

- Comparability

Comparability requires that LEAs be able to document that services provided with state and local funds in Title I schools are comparable to those provided in non-Title I schools.

ESSA

, Sec. 1118(c)(1)(A

) requires that “A local educational agency may receive funds under this part only if State and local funds will be used in schools served under this part to provide services that, taken as a whole, are at least comparable to services in schools that are not receiving funds under this part

paid with State and local

funds

staff paid with private or Federal funds

local educational agency may receive funds under this part for any fiscal year only if the State educational agency involved finds that the local educational agency has maintained the agency’s fiscal effort in accordance with section 8521”

Reminder:

Maintenance of Effort (MOE) is a provision which requires that an LEA maintain a 90 percent level of its expenditures for public education from

State and Local funds

from one year to the next. Slide22
