Conflict of Interest Training Training Purpose and Requirement This training module in Conflict of Interest (COI) is provided by the University of Delaware (UD) to inform and educate the members of the UD’s research community about applicable regulations, UD’s policy on COI, and the annual responsibility to disclose significant financial interests and conflicts of commitment to the University. Regulations UD’s Conflict of Interest in Research Policy Key Definitions Responsibilities and Procedures Outline Regulations Federal agencies have developed and published regulations to promote objectivity in research by establishing standards that provide a reasonable expectation that the design, conduct, and reporting of research funded under federally funded grants or cooperative agreements will be free from bias resulting from Investigator financial conflicts of interest. Department of Health and Human Services (HHS) initial regulations effective on 10-1-95 42 CFR Part 50 Subpart F (grants and cooperative agreements) 45 CFR Part 94 (contracts) Revised Final Rule published on 8-25-11 National Science Foundation (NSF) Proposal & Award Policies & Procedures Guide (PAPPG) Certification Regarding Conflict of Interest Financial Conflict of Interest Regulations CHIPS and Science Act of 2022 The CHIPS and Science Act requires research security training in areas which include disclosure, conflict of commitment and conflict of interest. National Security Presidential Memorandum-33 (NSPM-33) NSPM-33 requires that researchers fully disclose information that can reveal potential conflicts of interest and conflicts of commitment. Falsified disclosures and failures to disclose are subject to administrative action and/or legal prosecution and penalties. UD Conflict of Interest in Research Policy Policy 6-11 Conflict of Interest Policy and Procedures for Faculty and Professional Staff Involvement of faculty and professional staff with appropriate commercial enterprises is an important part of the transfer of knowledge and it is encouraged by the University to enhance both teaching and research programs. Association of faculty and professional staff with outside entities should be such that it benefits all the parties involved including the University. All employees are expected to conduct their professional and personal duties with maximum integrity, and to avoid association with any activities that could diminish the effectiveness of their commitment to the University. It is the responsibility and obligation of all faculty and professional staff to disclose all significant financial and commitment interests that may affect, or appear as if they could affect, their professional responsibilities.
