Manner in which advance money to be utilised

Promoter shall withdraw amount from earmarked bank a/c to cover the project cost in proportion to stage of completionWithdrawal permitted after % of completion certified by an Engineer, an Architect and a Chartered AccountantAccounts to be audited within 6 months after the end of financial year by the CAAuditor to certify that amounts collected have been utilized in the project and withdrawal from bank is in proportion to the % of completion

Construction plan and project specification

Proposed project shall be developed and completed as per sanctioned planIf any alteration or addition to be made, then written consent of at-least 2/3rd of allottees is required.In case of any structural defect, defect in workmanship or quality if brought to the notice of the promoter within 5 years, it should be rectified without further charges within 30 days else to be compensated.

Transfer of project to third party

Promoter shall not transfer his majority stake without prior written consent from 2/3rd allottees except promoterWritten approval of regulatory authority necessarySuch transfer shall not affect the sanctioned planOn the transfer being permitted by the allottees, intending promoter shall comply with provisions of this Act independently.

Return of advance and compensation

If the promoter fails to complete or is unable to give possession, In accordance with the terms, or by the specified date,Due to discontinuance of his business If the allottees wishes to withdraw from project, to return the amount received by him with interest.If the allottees does not intend to withdraw, interest for every month of delay to be paid.

The real estate appellate tribunal

Every bench of the Appellate Tribunal shall consist of at least 1 judicial & 1 Admin to technical Member.Aggrieved person can file appeal within 60 days from receipt of direction, order or decision made by RA.Endeavour shall be made by the tribunal to dispose of the appeal within 60 days.Appellant may either appear in person or can authorize CA, CS, Cost Accountant or Advocate.

Within 6 months, by 31.10.2016, the appropriate government (State Govt) will make rules and regulations regarding:Forms & manner of application and its enclosuresPeriod & condition of registrationMaintenance & preservation of Books of AccountsRate of interest for delays/defaultsForm & particulars of agreement for saleDetails to be published in websiteAny other matter it may deem fit.
