Copyright Laws

Copyright infringement applies to teachers with printed material, illustrations, photographs, video, music, computer software, the Internet, television, and more!

When you make copies, they must come from legally acquired original documents.

When copies are legally made for students, only one copy may be given to each student.“Consumables”, such as worksheets from workbooks, may not be copied. This is one of the largest and most misunderstood areas of copyright infringement concerning teachers.

Software Piracy

Software piracy is committed when a person shares, copies, downloads, sells, or otherwise uses software without permission of the copyright holder.

Installing licensed software on multiple computers may a violation of copyright law and can result in expensive and criminal legal actions.

A license that allows software to be installed on multiple computers is called a “site license” or a “multi-user license”.Software piracy can be punished by up to 5 years of imprisonment and $250,000 in fines, along with compensatory damages due to the copyright holder.

Software Purchasing Agreement

Purchasing software actually means that you are purchasing a license to use the software, not the software itself. The software purchasing agreement spells out the terms of that license, including how many times you may install that software.

Free software audit tools are available to make sure you are in compliance with the manufacturer of the software you are using.

Software purchasing agreements can be violated simply by swapping disks with a friend, coworker, or student.Networking software purchasing agreements allow multiple users. Make sure that the number of users at a given time doesn’t exceed the limit detailed in

the purchasing agreement!

Acceptable Use Policy (AUP)

An Acceptable Use Policy (AUP) for computer systems can include computers, cell phones, PDAs, networks, the Internet, printers, scanners, and other sorts of data.

These policies may include provisions that prohibit you from altering software.

Even if you don’t copy material yourself, you may not be safe. Your AUP may prohibit you from knowingly receiving any copyrighted material.Violation of these policies, which are a condition of employment, can result in disciplinary actions by your employer, up to and including termination of employment, as well as civil and criminal responsibility.
