Who is an Overseas Indian Elector 1/25/2017 CEO, Gujarat 5

Legal framework regarding registration of Overseas Electors 1/25/2017 CEO, Gujarat 6 Rule 8B (2) provides that as in case of other general electors, overseas electors shall also use Form 7, 8 and 8A for purpose of objection to inclusion of a name in the roll or correction, transposition of an entry from one part to another part of the roll of constituency, respectively.

Who is eligible to be registered? Every Indian citizen who has attained the age of 18 years on the qualifying date i.e. first day of January of the year of revision of electoral roll, unless otherwise disqualified. 1/25/2017 CEO, Gujarat 8

Activities of ERO (Electoral Registration Officer) and BLO (Booth Level Officer) ERO shall ask BLO to visit the home address mentioned in the passport of the overseas elector. The BLO shall ask relatives of applicant, if any, to verify the self-attested copies of documents and give a declaration (Annexure-43) to this effect. In cases, where, no relatives are available or relatives are not willing to give declaration for verification of documents or ERO is not satisfied with verification of documents by relatives, documents will be sent for verification to the concerned Indian mission in foreign country where applicant resides. 1/25/2017 CEO, Gujarat 12

Hearing/Objections for Overseas Elector If a personal hearing is necessary in respect to any claim or objection to inclusion of name in roll as overseas elector, the ERO shall designate and authorize an officer from Indian Mission at that particular country where applicant resides to hear the applicant for objection raised. If the objector is also available there then both parties are heard.The designated officer will send the report to ERO to enable him to make decision in the case.In no case, the personal appearance of applicant/objector living abroad shall be required by ERO in India 1/25/2017 CEO, Gujarat 13

Communication of the decision by ERO (Electoral Registration Officer) The decision of the ERO will be communicated to the applicant by post on his address in the foreign country given by him in Form 6A and also by SMS on the mobile number given by him in Form 6A. Electoral Rolls are also available online on the website of the chief electoral officer of the state concerned. You as an Overseas Elector, can find your name in the last part of the Electoral Roll under titled ‘Overseas Electors’ 1/25/2017 CEO, Gujarat 20

Other considerations for Overseas Electors (OE) In case you need to make changes in the details as published in the Electoral Roll (for instance the incorrect name or address etc), you will need to file and application in Form-8 and submit it to the concerned ERO. Overseas voter needs to inform the ERO when he returns and becomes citizen of India, so that his name in electoral roll as an overseas Indian elector can be deleted and on application in Form 6, he can be registered as a general elector at the place where he is ordinary resident in India It should be kept in mind that Overseas Elector can cast his vote only in person during the elections in his/her Constituency at the Polling Station provided for the part where he/she is registered as an Overseas Elector. You should bear in mind that as an Overseas Elector, you will not be issued EPIC, you can vote through vote in Polling Station on production of his original passport. 1/25/2017CEO, Gujarat21
