61. (REQUEST FOR DISCHARGE FROM ACCOUNTABILITY - MISSION BEACH COMPANY, SAN DIEGO ELECTRIC RAILWAY COMPANY, MISSION BAY LEASES, SAN DIEGO COUNTY - W.O. 429. ) The aforementioned lesson, together with the lease issued to Joseph E. Clarke, for which the Commission approved it request for Discharge from Accountability at its meeting of November 20, 1950, originated as agree-ments between the State Board of Barber Commissioners of San Diego and the above-mentioned parties. The Mission Beach Company lease was issued for a period of twenty-five years on August 21, 1924. The San Diego Electric Rail-way Compaty agreement was issued for a period of fifty years as of August 21,1925. Lands covered by the leases were transferred in 1945 from the State Board of Harbor Commissioners, San Diego, to the State Lands Commission pursuant to Attorney General's Opinion No. 4656 of February 8, 1943, effectiveof September 18, 1941, at which time the lessees were delinquent in rentals us fellows: Mission Beach Company, $830.00; San Diego Electric Railway Company, $59.00. The State Lands Commission brought the matter of these delinquent rental ascomets to the attention of the Attorney General's office for collection after efforts on the part of the staff to collect the mounts dus proved mevalling. Since that time there has been a considerable amount of corrs-pondenos between the Attorney General's office and attorneys representing the former losses. In response to a letter from the Commission requesting that action be taken to close these mocounts, the Attorney General ham advised thats ". . . We have corresponded with the representatives of both of the debtors, and we now believe that neither of the accounts is collectible and that the cost of further prosecution by means of letters or otherwise is such that our office is warranted in recommending the discharge from account-ability. Accordingly, and in reply to your lotter of December 8, we recommend that application for discharge be made to the State Board of Control.". UPON MOTION DULY MADE AND UNANIMOUSLY CARRIED, A RESOLUTION WAS ADOPTED AUTHORIZING THE EXECUTIVE OFFICER TO REQUEST FROM THE STATE BOARD OF CONTROL A DISCHARGE FROM ACCOUNTABILITY IN THE MATTER OF THE MISSION BEACH COMPANY AND THE SAN DIEGO ELECTRIC RAILWAY COMPANY LEASES, IN THE RESPECTIVE SUMS OF $830.60 AND $59.00, AND FURTHER AUTHORIZING THE AMOUNTS TO BE WRITTEN OFF THE RECORDS OF THE STATE LANDS COMMISSION UPON RECEIPT OF SUCH DISCHARGE FROM ACCOUNTABILITY. 32. (LEASE REVISION, P.R. C. 590, TUCLUMWE RIVER, STANISLAUS COUNTY, PACIFIC PAS AND ELECTRIC COMPANY - W.O. 1180.) UPON HOTION DULY MADE AND UNANIMOUSLY CARRIED, A RESOLUTION WAS ADOPTED AUTHORIZING THE EXECUTIVE OFFICER TO RAYIS'S BASEMENT NO. P.R. C. 590 ISSUED TO PACIFIC GAS AND ELECTRIC COMPANY 80 AS TO CHANGE THE LOCATION OF THE BASEMENT AREA, INCREASE THE LENGTH TO A TOTAL OF 170 FEET, AND INCREASE THE ANNUAL RENTAL FROM $42.80 TO #45.40 AS OF FEBRUARY 6, 1951, THE EFFECTIVE DATE OF THE AGREEMENT. Revision of location and length is at the request of the Company due toright-of-way troubles. Revision of rental arises from the increase of length by 80 feet. 1481
