Promotion of using SWB following UNECE Recommendation No.12Purpose: ・ To cope with B/L Crisis ・Adequate for digitalization ・Global Rule (Rotterdam Rules, CMI Rules )To promote: (1) To foster awareness of characteristics of SWB Seller/Buyer/Carrier/Forwarder/ NVOCC etc. (2) To foster awareness of the problem about Surrendered B/L Seller/Buyer etc. (3) To promote parties to prepare SWB process Seller/Buyer/Carrier/Forwarder/NVOCC/Bank etc. 3

4. So called ‘Surrendered B/L procedure’ B/L is used for this procedure Commonly used practice in Asian countries since middle of 80’s. (while SWB got common since 90’s )Typical process (1) Carrier issues B/L to Shipper at loading port. (2) Shipper endorses and returns Full set to above Carrier. (3) Carrier receives the full set and give shipper a photo copy of the original B/L with mark of ‘Surrendered’. (4) Carrier of discharging port release the cargo to consignee without receiving B/L(s). 4

5. Current situation quoted from comments of participants in the committeeOcean Carriers: Around more than 50% are SWBs. They prefer usage of SWB for saving the risk of B/L lost and caring for B/L surrender.Freight forwarders: Japan International Freight Forwarders Association Inc. (JIFFA) provides Multimodal Transport B/L form and SWB form. General image is that SWB portion is bigger than that of B/L. As NVOCC with carrier, usage of SWB is majority.5

6. Current situation quoted from comments of participants in the committee (Continued)Machinery exporters organization: (1) Big makers ( ex. Automobile, Home Electronics ) use SWB in many cases with group companies. (2) For non-group trade, they often use trading companies (Shosha). So the portion of L/C trade by trading companies is considerable. (3) Makers of precision and industrial instrument often use L/C trade. (4) For guidance, they suggested about a academy research report in 2010 ,reporting the portion of maritime trade document as B/L 36.3% SWB 42.5% and Surrendered B/L 21.2%. 6

7. Current situation quoted from comments of participants in the committee (Continued)A Bank : (1) L/C business: B/L > Surrendered B/L > SWB Export: B/L portion is big while SWB is minimal. Import: Surr. B/L portion is bigger than that of export and portion of this Surr. B/L is getting bigger. (2) Indicating ‘Bank’ as consignee in SWB Business procedure of Air Waybill (ex. Bank release order) is established while that of SWB is not yet fully in the same understanding among concerned parities.7
