THE 25 TH AMENDMENT After President Reagan’s attempted assassination, his Secretary of State claimed to be in charge at the White House. Does this align with the 25 th amendment? How does this compare to your experience?

THE 25 TH AMENDMENT After the assassination of President Kennedy, the twenty-fifth a mendment was passed in order to clarify what happens upon the death, removal, or resignation of the President or Vice President, and how the Presidency is temporarily filled if the President becomes disabled and cannot fulfill his responsibilities.

THE 25 TH AMENDMENT There are four sections of the 25th, this is Section 1 : T he process where the Vice President becomes President if the current President dies, resigns or is removed from office becomes official . On eight separate occasions, a President has died in office. Several other times the President has either resigned from or been removed from office.

THE 25 TH AMENDMENT There are four sections to the 25 th , this is Section 2 : If the Vice Presidency becomes vacant, the President may choose a new Vice President, who must be voted and approved by Congress before the candidate can have the position. On 7 occasions, the Vice President has died in office, and one Vice President, Spiro Agnew, resigned in the middle of his term. This has meant that for nearly 20% of U.S. history, there has been no Vice-President in office to assume the Presidency.

THE 25 TH AMENDMENT There are four sections to the 25 th , this is Section 3:T he president may temporarily make the Vice-President the Acting President with a written declaration.  This lasts until a second declaration is made that ends this condition .   This has been done a few times, as shown in the following slide.

THE 25TH AMENDMENT Section 4 of the 25 th Amendment has never been used! Sections 1 – 3 have all been used at one time or another.

THE 25 TH AMENDMENTThere are four key sections to the 25th amendment . This is Section 4:   T his emergency provision allows the Vice President and members of the Cabinet to declare the President unfit to carry out the duties of the Presidency.  The President may assert his competency (ability to serve) by sending a declaration to Congress.  The Vice President and Cabinet can submit another declaration against the President, which would force Congress to reach a 2/3 majority that the President is unfit for office.

DISCUSSION QUESTION In light of your new knowledge and reflecting on your experience in the simulation: If you were in charge during th e 1981 assassination attempt of President Reagan, would you choose to invoke the 25 th amendment?
